Item Coversheet Page 1 of 2 <br /> in <br /> Public Works <br /> DATE: 7/28/2017 <br /> MEMO: 2017-48 <br /> TO: Honorable Mayor Julie Moore Wolfe and City Council Members <br /> FROM: Tim Gleason,City Manager <br /> Richard G.Marley,P.E.,Public Works Director <br /> SUBJECT: <br /> Resolutions Authorizing a Professional Services Agreement with Crawford,Murphy,&Tilly,Inc.and a Local Agency Agreement <br /> with the Illinois Department of Transportation for Land Acquisition for the Brush College Road Improvement Project,City Project <br /> 2009-33 <br /> SUMMARY RECOMMENDATION: <br /> It is recommended that the City Council approve the attached Resolutions authorizing the Mayor to sign and the City Clerk to <br /> attest to the following items: <br /> 1. Resolution authorizing a professional services agreement between the City of Decatur and Crawford,Murphy&Tilly,Inc. <br /> (CMT)to perform land acquisition services for the Brush College Road Improvement Project for a fee not to exceed <br /> $168,375. <br /> 2. Resolution authorizing a Local Agency Agreement for State Participation with the State of Illinois for the use of Illinois Jobs <br /> Now! Funds for land acquisition for the Brush College Road Improvement Project utilizing the remainder of the City's <br /> Illinois Jobs Now!grant which is$2,006,014. The agreement amount includes the payment of 100%of the land acquisition <br /> services agreement with CMT for$168,375 and the remainder will be allocated toward property purchases. <br /> BACKGROUND: <br /> In April 2016,the City made a TIGER VII Grant Application for$20 million in Federal funds to design and build the Brush <br /> College Road/Faries Parkway Grade Separation and Improvement Project. Later in July 2016,the City learned it was not selected <br /> for a grant. <br /> In order to prepare for the next anticipated round of TIGER grants,the City asked for a debriefing from the US Department of <br /> Transportation(USDOT)to learn of short-comings in the City's grant application. Staff was advised that the most significant <br /> short-coming was that the City is not far enough along on the project to compete well against other applicants. The USDOT <br /> officials advised the City to take steps to move the project along towards implementation including the acquisition of needed <br /> rights-of-way. The City still has access to slightly more than$2.0 million in Illinois Job Now!Grant funds through the State of <br /> Illinois. City staff has confirmed through Illinois Department of Transportation grant administrators that the funds can be re- <br /> allocated for the purchase of rights-of-way. <br /> Land Acquisition Services Agreement <br /> Land acquisition using State or Federal funds or for projects that may be State or Federally funded,must adhere to strict processes <br /> under Federal law to assure fair value is received by both the City and property owner. The land acquisition agreement includes <br /> the following services: <br /> 1. Collect property data,including title reports and title insurance. <br /> 2. Perform any required land surveys and prepare right of way documents. <br /> 3. Complete cost appraisals for each property proposed for purchase. <br /> 4. Complete a review appraisal for each appraisal prepared. A review appraisal is performed by a separate appraiser to assure <br /> that a correct and fair appraisal was completed. <br /> 5. Perform property acquisition negotiations. <br /> 6.
