DECATUR FIRE DEPARTMENT
g MEMORANDUM
17-08
Date: August 15,2017
To: Honorable Mayor Julie Moore Wolfe
City Council Members
From: Tim Gleason, City Manager
Jeff Abbott, Fire Chief
RE: Pierce Intergovernmental Agreement
SUMMARY RECOMMENDATION:
The Resolution Council is being asked to approve would authorize the City of Decatur to enter
into an Intergovernmental Agreement to pursue action, including possible legal action, against
Pierce Manufacturing, Inc. for issues with certain fire apparatus that we have purchased.
BACKGROUND:
The City of Decatur owns one 2001 Pierce fire apparatus that has suffered some serious frame
corrosion issues and has had to be taken out of service. The entire fire department fleet of twelve
(12) fire apparatus are all Pierce vehicles. We have attempted to resolve the problem with the
representatives of Pierce and their representatives without success.
In investigating possible solutions,we discovered that other communities have experienced similar
problems with their Pierce apparatus. The communities who have experienced similar problems
have entered into an Intergovernmental Agreement in an attempt to reach a favorable resolution of
this matter through the hiring of legal counsel and experts in products liability issues to determine
what,if any, remedies may be available. They have asked Decatur to join their efforts. The costs
for each community is determined based on the percentage of population. The City of Decatur's
proportionate share would be 17.08% based on the current signatories to the Intergovernmental
Agreement who are Normal, Champaign, Danville, Peoria, Charleston and Ottawa.
POTENTIAL OBJECTION: None
STAFF REFERENCE: Jeff Abbott, Fire Chief, 424-2811. Chief Abbott will be at the council
meeting to answer any questions the Council may have.
BUDGET/TIME IMPLICATIONS: This Intergovernmental Agreement would cover only the
investigation and attempts to resolve this matter but not litigation or the actual filing of a complaint
