141.0501 1 <br /> BOOK 2 5 9 3 PAGE 264 <br /> AGREEMENT <br /> WHEREAS, there is a petition to vacate the real estate shown <br /> on the exhibit attached hereto which is the easement for ingress <br /> and egress of Clubview Place Addition, as per Plat recorded in book <br /> 300, page 307, of the records in the Recorder's Office of Macon <br /> County, Illinois; and <br /> WHEREAS, the undersigned, Magna Trust Company, Trustee under <br /> Trust Agreement dated October 29, 1994 is the owner of Lot 1, and <br /> Eric C. Brechnitz and Nancy B Brechnitz are the owners of Lots 2 <br /> and 3, and Roy C. Townsend, Jr. and Ellen Jane Townsend are the <br /> owners of Lot 4, and Herbert L. Roszell, Jr. and Opal Backes <br /> Roszell are the owners of Lot 5, the aforesaid five (5) lots being <br /> all the lots in Clubview Place which have ingress and egress under <br /> the real estate aforesaid. <br /> NOW THEREFORE, be it agreed by the undersigned that they, <br /> their heirs, executors, administrators, assigns and successors in <br /> interest shall have the right of reasonable ingress and egress over <br /> and upon the real estate described above as vacated, and said <br /> ingress and egress shall be restricted to them, their invitees, and <br /> persons using the real. estate with their permission, and shall not <br /> be available for ingress and egress by the general public. <br /> That the undersigned shall also have the right to use the <br /> aforesaid vacated real estate for public and private utilities and <br /> the maintenance, service and repair thereof. <br /> That this instrument shall be placed of record in the <br /> Recorder's Office of Macon County, Illinois, and this instrument <br /> shall be binding upon and inure to the successors in title of the <br />
