from any and all claims, demands,damages,rights of action or causes of action,present <br /> or future,whether the same be known,anticipated or unanticipated,whether due to <br /> negligence or otherwise,resulting from or arising out of Lessee's use of the Premises. <br /> 9. Indemnification. To the extent provided by law,Lessee shall indemnify <br /> and hold harmless Lessor,and its officers, employees or agents in both individual and <br /> official capacities from all claims for bodily injury or death resulting from or arising out <br /> of Lessee's use of the Premises, and from all costs, demands, suits, losses, attorney fees, <br /> and liabilities incurred in or about any such claim for bodily injury or death,or any action <br /> or proceeding brought herein. <br /> 10. Insurance Requirements. Lessee shall obtain, at its expense, and keep <br /> in force during the term of this Lease,comprehensive general liability and property <br /> damage insurance in an amount of not less than$1,000,000 single limit, $2,000,000 <br /> aggregate, for bodily injury,death and property damage to any one person and subject to <br /> the same limitations for any one occurrence. The comprehensive general liability policy <br /> shall include coverages for premises and operations,a blanket contractual liability <br /> coverage which includes the indemnification agreement contained in the next paragraph, <br /> broad form property damage,independent contractors and personal injury liability <br /> coverage. The policy issued for the afore-described coverages shall name the City of <br /> Decatur,Illinois,as an additional insured. Such insurance shall not be canceled prior to <br /> termination of this Lease. <br /> 11. Certificate of Insurance. Prior to the commencement of each annual <br /> term of the Lease,Lessee shall file with the City a Certificate of Insurance, in a form <br /> acceptable to the City, signed by an authorized agent of the insurance company or <br /> companies writing the insurance described in said Certificate showing complete coverage <br /> of all insurance required in this Lease. Such Certificate shall certify to the <br /> following: Name and address of party insured;name and address of authorized agent <br /> executing such Certificate;the description of the type of insurance,and the coverages <br /> afforded thereunder,the insurance policy numbers;the limits of liability of such policies <br /> and the date of expiration of such policies. It is an affirmative obligation upon the <br /> Lessee to advise Economic and Community Development Director Ray Lai at the City of <br /> Decatur, 1 Gary K. Anderson Plaza,Decatur,IL 62523 within two days of the <br />
