ORDINANCE NO. 2018- 14 AMENDED ORDINANCE AUTHORIZING CONSUMPTION OF ALCOHOLIC LIQUOR ON PUBLIC RIGHTS-OF-WAY AND IN CENTRAL PARK -DECATUR SMOKIN' BBQ FESTIVAL- WHEREAS,the Decatur Smokin' BBQ Festival,has requested the closure of public streets and Central Park in downtown Decatur beginning Friday, October 5, 2018 and continuing through Saturday, October 6,2018;and, WHEREAS, it is the intention of the Decatur Smokin' BBQ Festival to offer alcoholic beverages for sale to patrons for consumption at this event; and, WHEREAS, such consumption of alcoholic liquor on public rights-of-way and in Central Park requires the express approval of the City Council; and, WHEREAS,the Council finds that it would be in the best interest of the Decatur Smokin' BBQ Festival and of the City of Decatur that such consumption of alcoholic liquor as described be permitted for said limited time period. NOW, THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1.That on the days listed herein,and only on such days,between the hours listed opposite each,alcoholic beverages may be consumed at,in or on those portions of public rights-of-way described in Section 2 hereof,and in Central Park located in downtown Decatur, said days and hours being particularly described as follows: Friday,October 5,2018 4:00 p.m. -10:00 p.m. Saturday,October 6,2018 11:00 a.m.— 10:00 p.m. Section 2. That those portions of public rights-of-way at, in,or on which the above named alcoholic liquor may be consumed, on the days and during the hours listed in Section 1 hereof, are described as follows: Central Park North Park Street Approximately Five Parking Spaces on the North Side of South Park Street Section 2. That no alcoholic liquor may be consumed as provided herein unless such alcoholic liquor is in a plastic or paper cup. Section 3. That this ordinance is expressly conditioned and approved upon Decatur Smokin' BBQ Festival providing to the City of Decatur an agreement which will hold the City harmless for any and all damages incurred by persons attending this event and indemnifying the City for any and all damages and lawsuits. Section 4.That all debris shall be removed by Decatur Smokin' BBQ Festival prior to reopening public rights-of-way.
