c a <br /> AGREEMENT BETWEEN THE MACON COUNTY PUBLIC SAFETY TRAINING <br /> FOUNDATION AND THE <br /> CITY OF DECATUR,ILLINOIS,ACTING BY AND THROUGH THE POLICE <br /> DEPARTMENT, FOR USE OF THE GRANT FARM <br /> LAW ENFORCEMENT TRAINING CENTER <br /> This Agreement ("Agreement") is made by THE MACON COUNTY PUBLIC SAFETY <br /> TRAINING FOUNDATION,a not-for-profit corporation(the"Foundation"),and THE CITY OF <br /> DECATUR, ILLINOIS, a body politic and corporate under the laws of the State of Illinois, acting <br /> by and through the Police Department(the"City"or the"Police Department"),with reference to <br /> the following facts, and subject to the following terms and conditions: <br /> RECITALS <br /> A. The Foundation owns the Grant Farm Law Enforcement Training Center located at 1925 <br /> Heritage Road, Decatur, Illinois (the "Facility"). <br /> B. The Foundation now desires to allow certain units of the Police Department to use the <br /> Facility, subject at all times to the terms and conditions of this Agreement. <br /> ARTICLE ONE—GENERAL TERMS <br /> A. In consideration for the City's covenants hereinafter expressed and made, the Foundation <br /> grants to the Police Department non-exclusive access to and use of the Facility on days exclusively <br /> determined by the Foundation. <br /> B. The City agrees that the Foundation shall maintain control of the Facility and further agrees <br /> to abide by the Foundation's operational rules for the Facility, which rules and subsequent <br /> amendments shall be provided by the Range Master to the Police Department personnel utilizing <br /> the Facility. <br /> ARTICLE TWO—PARTICULAR TERMS AND CONDITIONS <br /> A. The Facility is available to the City only for tactical training of law enforcement officers <br /> employed by the Police Department, and specifically only for use by officers in the ERT, Street <br /> Crimes, and K-9 units. <br /> B. The Facility may be scheduled by Police Department personnel by contacting the <br /> Foundation's Range Master for available dates. <br /> C. The Police Department acknowledges that other parties, including personnel of the Macon <br /> County Sheriff's Office, Illinois State Police, Macon County Law Enforcement Training Center, <br /> National Criminal Enforcement Association, and the FBI will be using the Facility from time to <br /> time. <br />
