Shade,Thomas M. Shade, Sarah M. Peterson,as Trustee of the Sarah M. Peterson Trust, and William P. <br /> Shade III, as Trustee of the William P. Shade III Trust <br /> SUMMARY RECOMMENDATION: <br /> It is recommended that the City Council approve the resolution authorizing the execution of a temporary construction easement <br /> agreement between the City of Decatur and Jeffrey L. Shade,Thomas M. Shade, Sarah M. Peterson, as Trustee of the Sarah M. <br /> Peterson Trust,and William P. Shade III, as Trustee of the William P. Shade III Trust, and that the Mayor be authorized to execute <br /> the agreement and the City Clerk to attest. <br /> BACKGROUND: <br /> County Fair Drive is scheduled for reconstruction ahead of the opening of the Love's Travel Stop and Country Store. A temporary <br /> easement from the adjacent property owners is necessary for the road reconstruction. All costs associated with the preparation and <br /> execution of the temporary easement is provided by Loves. The temporary easement also provides a future 2-inch water tap for no <br /> cost to the property owner. <br /> SCHEDULE: County Fair Dr.reconstruction is expected to start in September 2018. <br /> LEGAL REVIEW: The easement was received and reviewed and approved by Legal Counsel. <br /> PRIOR COUNCIL ACTION: <br /> May 21,2018—Council approved Resolution R2018-51 authorizing a Redevelopment Agreement Love's Travel Stops and <br /> Country Stores, Inc. <br /> May 21,2018—Council approved Resolution R2018-52 authorizing a City Rider to the Highway Permit with Illinois Department <br /> of Transportation for Love's Travel Center and Country Stores,Inc. <br /> May 21,2018—Council approved Resolution R2018-53 authorizing a temporary construction easement between the City of <br /> Decatur and Clifford Mason. <br /> May 21,2018—Council approved Resolution R2018-54 authorizing a temporary construction easement between the City of <br /> Decatur and Carol Klepzig. <br /> May 21,2018—Council approved Ordinance 2018-22 authorizing a Lift Station Easement and Access Agreement between the <br /> City of Decatur and Clifford Mason. <br /> POTENTIAL OBJECTIONS: There are no known objections. <br /> INPUT FROM OTHER SOURCES: <br /> Love's Travel Stop and Country Store,Inc. <br /> Page 1 of 2 <br />
