3.5 Project Documents. The Project Documents include: ■ An executed version of this Agreement ■ The Report • COMPANY Submittals specified in paragraph 2.3. Certificates of Insurance ■ Executed Performance Bond and Labor and Material Payment Bond • Drawings, Specifications and Surveys furnished by the CITY in accordance with paragraph 2.4. The Project Documents also include the following Schedules which are incorporated herein and made a part of this ESA when approved by the CITY and COMPANY: Schedule A EMs to be Installed Schedule B Energy Savings Guarantee Schedule B2 Assured Performance Guarantee– Utility Meters Schedule C Compensation to Company Schedule D Premises Schedule E Calculation of Baseline/Benchmarks Schedule F Company Maintenance Responsibilities Schedule G CITY Maintenance Responsibilities Schedule H Operating Parameters for EMs/Standards of Comfort Schedule I Company Training Responsibilities Schedule J Project Installation Schedule Schedule K Pre-Installation Equipment Inventory Schedule L Methods of Savings Measurement and Verification Schedule M Systems Startup and Commissioning of EMs Schedule N Alternative Dispute Resolution Procedures Schedule O Insurance and Bonds Schedule P Warranties Attachment A Construction Process Provisions . Exhibit I Notice to Proceed Exhibit 11 Form of Change Order Exhibit III Certification of Substantial Completion Exhibit IV Certification of Acceptance—Energy and Water Efficiency Audit Report Exhibit V Certification of Final Completion 3.5.1 Project Documents Furnished by the CITY; No Warranty. Pursuant to paragraph 2.4(c), the CITY shall make available for the COMPANY'S review, inspection, and duplication at COMPANY'S expense, such Project Documents as it may possess which relate to any Work being performed by other Companies at the Premises under separate contracts with the CITY unrelated to the COMPANY's performance of the Work under this Agreement, including but not limited to drawings, specifications, surveys and as-built drawings. The furnishing of such Project Documents by the CITY shall not constitute a warranty as to the accuracy or completeness of such Project Documents. 3.5.2Review of Project Documents; Notification to the CITY. The COMPANY shall carefully review all Project Documents, including all addenda, whether prepared by the COMPANY, its subcontractors or furnished by the CITY for errors, inconsistencies or omissions relative to the performance of the Work.
