The location of the subject site allows
easy access to Interstate 72 or Route 51. However, in keeping with the recommended use of the
site for retail in the Comprehensive Plan and considering the surrounding uses, staff if of the
opinion that the primary use of the building should remain as commercial. No more than 50% of
the units should be residential.
Depending on the final number of office and residential units, adequate parking has to be
provided that meets the minimum off-street parking requirements for both types of uses.
The proposed use also meets the second standard. The facility is located and designed to be
operated in a manner in which the public health, safety and welfare will be protected. If the
Conditional Use Permit is approved for three (3) or more residential units, the building would be
classified as commercial with residential usage. Therefore, according to Section 903.2.8 of the
2009 International Building Code, all residential units must be protected with an automatic
sprinkler system.
Lastly, the facility should not cause injury to the value of other properties in the areas as stated
by the third standard. The commercial building has been at this location for a number of years
and it seems not to have had any detrimental effects on the area.
The Conditional Use Permit application has been reviewed by the City's Technical Review
Committee, with Planning and Sustainability Division,Engineering Division, and Fire Inspection
Division have all approved the proposed mixed use development.
STAFF RECOMMENDATION
Staff recommends approval of the petition with the following conditions:
1. Two full sets of sealed architecture plans will be required due to the change in use of the
building.
2. All residential units must be protected with an automatic sprinkler system, if three (3) or
more residential units are proposed.
3. No more than fifty(50)percent of the number of units can be residential units.
4. All off-street parking shall meet the requirements of the Zoning Ordinance.
5. Final site, landscaping and lighting plans shall be submitted to and approved by the
Economic and Community Development Department, Public Works Department and the
Fire Department prior to permits being released.
PLAN COMMISSION ACTION
Section XXII.A.2. requires the Plan Commission to hold a public hearing on a Conditional Use
Permit request, and then forward its report and recommendation to the City Council for a final
decision. A motion to forward Calendar 18-24 to City Council by the Plan Commission with a
recommendation for approval is suggested.
