all notices to the City referenced in the Collective Bargaining Agreement shall be given to the <br /> Chief of Police, or his designee, and the Assistant City Manager for Administration. The Union <br /> shall notify the City in a timely manner of any personnel changes to the Union Executive Board <br /> and the Office of the President, and the City shall notify the Union in a timely manner of any <br /> personnel changes in the positions of Chief of Police and Assistant City Manager for <br /> Administration. <br /> ARTICLE 2 <br /> PLACE OFRESIDENCE <br /> The Residency article remains open. The parties have agreed to all of the provisions of the Labor <br /> Agreement with the exception of the Residency article. The Residency article will be subject to <br /> interest arbitration before a neutral arbitrator selected by the parties. In order to afford employees <br /> salary increases included in the agreed upon provisions prior to resolution of the Residency <br /> article,the parties have agreed to implement the remainder of the provisions of the Labor <br /> Agreement upon ratification of the membership and approval by the City Council of the City of <br /> Decatur. The below language will remain in effect until the Award of the Arbitrator.After a final <br /> decision of the Arbitrator, subject to any review,the Labor Agreement will be updated to reflect <br /> the Arbitrator's decision, if appropriate, on the Residency article. <br /> Section 1. (a) Persons appointed to positions in the classified police service prior to May <br /> l, 2013 shall reside within forty(40)miles of the corporate limits of the City of Decatur. Persons <br /> appointed to positions in the classified police service May 1,2013 and thereafter shall reside within <br /> the corporate limits of Macon County,or within the corporate limits of any municipality extending <br /> into Macon County. Upon original appointment, an appointee may reside outside said limits but <br /> shall be required as a condition of continued employment to comply with said residency <br /> requirement no later than ninety (90) days after the completion of said appointee's probationary <br /> period. All non-probationary officers residing outside said residency requirement and employed <br /> by the City on April 30, 1997 shall not be required to comply with said residency requirement. <br /> (b)Officers who are assigned to K-9 duty by order of the Chief of Police shall reside within <br /> Macon County, or meet the residency requirement defined in Section 1 (a) of this article, <br /> whichever is more restrictive, for the period during which said officers are so assigned. <br /> Section 2. In the event that an employee cannot report for duty at the assigned time, <br /> for any reason related to the location of the employee's place of residence if such is not in Macon <br /> County, the employee may call an on-duty command officer to request an emergency holiday if <br /> the employee has accumulated holiday time sufficient to cover the duty day or time of delay in <br /> reporting to work. The request will be granted, if at the time of the request, the affected shift or <br /> unit has staffing sufficient to provide police service at the level required by the anticipated <br /> workload for that time period. <br /> If, in the opinion of the command officer on duty at the time of the request,the anticipated <br /> workload is such that adequate police service cannot be provided with the reduced staffing caused <br /> 2 <br />
