ORDINANCE NO. 2 018-4 7 <br /> ORDINANCE AMENDING ZONING ORDINANCE <br /> - SECTION II. DEFINITIONS- <br /> -SECTION XII. B-2 COMMERCIAL DISTRICT - <br /> - SECTION XIV. B-4 CENTRAL BUSINESSS DISTRICT- <br /> SECTION XVI. M-1 INTENSE COMMERCIAL-LIGHT INDUSTRIAL DISTRICT <br /> (Truck Stop Establishments) <br /> WHEREAS, on the 6th day of September, 2018 upon due notice,the Decatur City Plan <br /> Commission held a public hearing on the petition of Raymond Lai, Director of Economic and <br /> Community Development, to modify and amend the Zoning Ordinance of the City of Decatur,the <br /> same being Ordinance No. 3512, as amended, by amending Sections II. DEFINITIONS, XII. B-2 <br /> Commercial District, XIV. B-4 Central Business District, and XVI. M-1 Intense Commercial-Light <br /> Industrial District thereof, so that said Sections II., XII., XIV., and XVI. as modified and amended <br /> shall provide as set forth herein. <br /> II. Definitions <br /> LICENSED TRUCK STOP ESTABILSHMENT: A facility (i)that is at least a 3-acre facility <br /> with a convenience store, (ii) with separate diesel islands for fueling commercial motor <br /> vehicles, (iii)that sells at retail more than 10,000 gallons of diesel or biodiesel fuel per <br /> month, (iv)that in its entirety locates within one-half mile (or 2,640 feet) of the rights-of-way <br /> of existing interchanges along Interstate 72, or the interchange of U.S. Business Highway 51 <br /> and U.S. Highway 51, within Decatur City limits, and (v)with parking spaces for <br /> commercial motor vehicles. "Commercial motor vehicles" has the same meaning as defined <br /> in Section 18b-101 of the Illinois Vehicle Code. The requirement of item(iii) of this <br /> paragraph may be met by showing that estimated future sales or past sales average at least <br /> 10,000 gallons per month. <br /> AUTOMOBILE SERVICE STATION: Any building or structure used for the retail sale of any <br /> automobile fuels and lubricants from no more than six (6)pumps located on no more than <br /> three (3) bays and any combination of one or more of the following uses: (1) retail sale of <br /> new automobile parts, accessories, and supplies when ancillary to the repair and maintenance <br /> of motor vehicles; (2) all uses listed under the definition of Automobile Repair and service. <br /> Minor; and(3) minor repair and maintenance of automobiles and trucks not exceeding a 2- <br /> ton capacity, excluding there from all uses defined as Automobile Repair and Service-Major. <br /> Convenience items, such as snack foods and beverages, may be sold through vending <br /> machines and over-the-counter sales,provided they do not occupy more than 100 square feet <br /> of the indoor floor space of the establishment. (See Convenience Food and Beverage Store, <br /> Convenience Food and Beverage Store, Extended Hours, Gasoline Station, and Licensed <br /> Tuck Stop Establishment). <br />
