3.4 Seller Construction Obli ations. In conjunetion with the development of the <br /> Premises the City hereby agrees that it will undertake and complete the construction af certain <br /> improvements to streets and sidewalks in the Wabash Crossing area in the 200-300 Blocks of East <br /> Central Avenue,the$00 Block of North Warren Street and the 200-500 Blocks af East King Street <br /> as generally d�picted on the site plan attached hereto as Exhibit C(collectively,the"VVork"}. The <br /> Work is anticipated ta cast $584,303.41 with a potentiai for 10% contingency bringing the <br /> estimated potential total to $614.303.41 and upan completion af the work the City will maintain <br /> the aforementioned streets and related infrastructure as part of the public roadway system. The <br /> City shall complete work on East Central Avenue and North Warren Street in 2019 and shall <br /> complete work on East King Stareet in 2020. <br /> 3.5 Closin�.The tirne and place of settlement on the date of closing shall be fixed <br /> by mutual agreement of the parties not more than 30 days after the effective date of this agreement. <br /> At the settlernent Buyer shall deliver to Seller or cause to be paid: <br /> (i) All docuznents as Seller's counsel may reasanably require. <br /> (ii) An amount equal ta the cost of recording any release of indenture of mortgage <br /> or trust deed; and, <br /> {iii) An amount equal to the cost of Illinois revenue starnps if required to be affixed <br /> to Seller's quitclaim deed. <br /> (iv) An amount equal to any and all casts associated with the transfer of <br /> awnership to Premises including but not limited to any real estate taxes unpaid and <br /> due after the date of clasing prarated ta the date of closing, based upon the last <br /> ascertainable real estate t�es on the Premises; the fee charged by the Title <br /> Company for closing the sale; the fee for recording the deed;the cost of an survey; <br /> and the cost of tlie title cammitment and policy. <br /> Seller shall deliver ta Buyer: <br /> (i) Its executed quitclaim deed to the Premises, containing only those <br /> exceptions listed in subparagraphs (i) thraugh (v), inclusive, of paragraph 3.2 <br /> above. <br /> 4 <br />
