R2018- 12 6 RESQLUTION REGARDING TEMPORARY CLQSURE QF CERTAIN Dt�WNTOWN SIDEWALKS -DECATUR CELEBRATIUN- WHEREAS,tlae City Council recagnizes the many bezaefits,econan�ic and other,that the annual Decatur Celebration brzngs ta the City of Decatur and surrouncling area; and, WHEREAS,there is substantial public interest in supporting, financially atxd otherwise, the Decatur Celebration;and, WHEREAS, there is substantial public benefit in supportang, financially and 4therwise, the Decatur Cetebration; and, WHEREAS, the City Cauncil recognizes that the temporary closure af certain dawntown sidewalks for the Decatur Celebration will substantially benefit the Decatur Celebratian and serve the public interest; and, WHEREAS, the City of Decatur's downtown pubiic sidewallcs serve legitimate public interests including pedestrzan travel and access to public and private property, including for buszness,employment, and recreatianal purposes; and, Vd'HEREAS,temporariiy closing certain downtown sidewalks to atl but paid attendees of the Celebratian,dowzitown.residents,and persans legitimateiy engaged in employrnent aridlor business acrivities downtown wili substantialiy benefit the Decatur Calebrat�an, and, WHEREAS,temgorarily closing certain downtawn sidewalks ta all but paid attendees of the Celebration,C�C1W11�0WT1 F�SI{�8I1�Sy and persons legitimately engaged in employment and/or business activities downtoum will not unreasonably infringe upon t�ther's rights to enjoy the said sidewalks,access public or private property,or engage in protected speech; and, WHEREAS,tempararily closing certain downtown sidewalks to all but paid attendees of the Celebration, downtown residents,and persons legitimately enga�ed in employmez�t and/or business activities downtawn is a legitimate exercise Qf municipal authority. NUW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL 4F THE CITY QF DECATLTR, ILLINOIS: Sectic►n 1. Those portions of the City of Decatur downtown sidewalks located within the "fot�tprint"of the Decatur Celebration, as identified on the attached Exhibit"A", sha.11 be temporarily closed, from 3:00 P.M. an Friday, August 2, 2019,through 9:30 P,M. on 5unday, August 4,2019,ta al1 but the foilowing persons: 1. Paid attendees of the Decatur Celebration, and
