CITY COUNCIL MEMORANDUM
NO.2018-11
October 31,2018
TO: Honorable Mayor Moore Wolfe and City Council
FROM: Billy Tyus, Interim City Manager
Wendy Morthland, Corporation Counsel
SUBJECT: Amendments to Chapter 41 —Miscellaneous Street Regulations
SUMMARY RECOMMENDATION: Staff requests that Council pass the proposed ordinance
amendments regarding Chapter 41, Section 5 and Section 12.
BACKGROUND: The amendments to Chapter 41 of the City Code would provide a manner to
provide for the display of sidewalk signs in the B-4 Central Business District. The amendments
attempt to provide a constitutionally sound mechanism for the use of the public rights of way and
utilize the process currently in place for the use of public rights of way for outdoor cafes.
The ordinance would allow sidewalk signs under the following guidelines and rules:
• Sidewalk signs would be limited to property owners or leasees in the B-4 Central
Business District.
• Sidewalk signs would be required to be sandwich board type signs and could be a
maximum of 6 square feet in area on any one of two sides and no greater than 4 feet in
height. This is the same as those allowed with outdoor cafe permits.
• Sidewalk signs could not be illuminated.
• Sidewalk signs can be placed on public rights of way only between the hours of 7 a.m.
and 10 p.m.
• The fee for sidewalk sign permits shall be$25.
• Permittees would be required to indemnify the City as a condition of the permit as well
as provide liability insurance in the same manner as outdoor cafe permittees.
• Only 1 sign would be allowed per property.
• Placement of sidewalk sign would have to allow sufficient passage under the ADA with
a minimum of 4 feet of open walking space and may not obstruct the line of sight for
traffic.
POTENTIAL OBJECTIONS: N/A.
INPUT FROM OTHER SOURCES: N/A.
STAFF REFERENCE: Wendy Morthland, Corporation Counsel, at 424-2807.
BUDGET/TIME IMPLICATIONS: N/A.
