Item Coversheet 12/12/2018 12:42:28 PM
fl
Public Works
DATE: 12/4/2018
MEMO: 2018-58
TO: Honorable Mayor Julie Moore Wolfe and City Council Members
FROM: Billy Tyus,Interim City Manager
Matthew C.Newell,P.E.,Public Works Director
SUBJECT:
Resolution Authorizing an Amendment to the Agreement with Crawford,Murphy&Tilly,Inc.to Perform Land
Acquisition Services for the Brush College Road Improvement Project,
Section No. 17-00933-00-LA
City Project 2009-33
SUMMARY RECOMMENDATION:
It is recommended that the City Council approve the attached Resolution autharizing the Mayor to sign and the City Clerk to attest
to a Resolution autharizing an Amendment to the Agreement between the City of Decatur and Crawford,Murphy&Tilly, Inc.
(CMT)to perform additional land acquisition services for the Brush College Road Improvement Project for an additional fee of
$339,3ll which is added to the original fee of$168,375 for a total fee of$507,686.
BACKGROUND: On Apri125,2017,the Public Works Department issued a Request for Proposals to perform Land Acquisition
services for the entire Brush College Road project extending from William Street on the south to Harrison Avenue on the north.
At the time, these services were sought to address a significant short coming in the Brush College Project in that the City was not
actively purchasing right-of-way for the future work. On August 7,2017,the City Council approved a professional services
agreement with Crawford, Murphy&Tilly, Inc.to provide these services for the project. At the time, there was no approved
funding for the Brush College Road project and therefore the initial scope of services was limited to those whole property takes on
the southeast corner of Faries Parkway and Brush College. The Illinois Department of Transportation(IDOT)provided approval
for the land acquisition work to begin in the late spring of this year.
On June 5,2018,the City received the announcement of the award of a$25 million grant through the Illinois Competitive Freight
Program for the Brush College/Faries Parkway Grade Separation Project. On October 1, 2018,the City Council authorized an
engineering design services agreement with AECOM to design the improvement of the north section of the Brush College Road
project at Faries Parkway. That agreement is still pending the approval of IDOT and the Federal Highway Administration.
Land Acquisition Services Amendment
Approximately 19 additional properties will need to be acquired prior to the commencement of construction. In addition, the City
will need to assist Ameren in relocating a substation and some overhead electrical lines. All land acquisition using State ar Federal
funds must adhere to strict processes under Federal law to assure fair value is received by both the City and the property owner.
The land acquisition work conducted by CMT includes the following services:
1. Collect property data, including title reports and title insurance.
2. Work with AECOM to have right-of-way documents prepared.
3. Complete cost appraisals for each property proposed for purchase.
4. Complete a review appraisal for each appraisal prepared. A review appraisal is performed by a separate appraiser to assure
that a correct and fair appraisal was completed.
5. Perform property acquisition negotiations.
6. Provide relocation assistance to the property owner as needed.
7. Assure that all State and Federal requirements are met in the process.
