Economic&CoiYunuuity Development <br /> DATE: 3/4/2019 <br /> MEMO: No. 19-OS <br /> TO: Honorable Mayor Julie Moore Wolfe and City Council <br /> FROM: Wendy Morthland,Interim City Manager <br /> Raymond Lai,AICP,Economic and Community Development Director <br /> Scott Dedert, Seniar Planner <br /> SUBJECT: <br /> Ordinance Repealing Ordinance 2019-01 and Ordinance Approving Rezoning Property from B-2 Commercial District To M-1 <br /> Intense Commercial-Light Industrial District at 3373 North Woodford Street <br /> SUMMARY RECOMMENDATION: Staffrecommends repeal of Ordinance 2019-01,which approved the subject rezoning. <br /> Also,staff recommends the approval of a new ordinance for the re-wning. The City Plan Commission voted 7-0 to recommend <br /> approval of this latest petition at the February 7,2019 meeting;the relevant draft minutes of the meeting are attached. <br /> BACKGROUND: <br /> Ordinance 2019-01 was recently considered and approved by the City Council on January 7, 2019. However, in order to meet <br /> certain requirements of the Open Meetings Act, the rezoning case had to go through the public hearing process with the Plan <br /> Commission again. At their February 7, 2019 meeting, the Plan Commission unanimously voted to recommend approval of the <br /> petition. <br /> The property located at 3373 North Woodford 5treet contains both B-2 Commercial District and M-1 Intense Commercial-Light <br /> Industrial District. The northern portion of the properiy proposed to be re-zoned consists of approacimately 0.46 acres and is a <br /> parking lot and part of an animal shelter building. On the southem part of the parcel, zoned M-1 Intense Commercial-Light <br /> Industrial District,there is part of that animal shelter building (Humane Society of Decatur and Macon County). <br /> The intent of the rezoning request is to create a uniform zoning district for the overall properiy. <br /> The subject site is located witlun a mixed-use area and rezoning to M-1 Intense Commercial-Light Industrial District should have <br /> no adverse effect on the general area or the City as a whole. <br /> POTENTIAL OBJECTIONS: No objectors spoke at the Plan Commission meeting. <br /> INPUT FROM OTHER SOURCES: <br /> The petition has been reviewed by the City's Technical Review Committee;Planning,Engineering and Fire. <br /> STAFF REFERENCE: Any additional questions may be forwarded to Scott Dedert sdedert@decaturil.gov,or Raymond Lai <br /> at 424-2727 or rlai@decaturil.gov. <br /> BUDGET/TIME IMPLICATIONS: None <br /> ATTACHMENTS: <br /> Description Type <br /> Ordinance of Repeal Ordinance <br />
