Brandon, Inc., as legatee of MeIvin H. <br /> Brandon, deceased(09-P-314) as owner and Seller under a certain Contract for Deed <br /> (hereinaftez"Brandon"), KEVIN WATKINS,individually and as President of SRKW, <br /> INC., Buyer under the#erms of a certain Contract for Deed(hereinafter"Watkins"), and <br /> WAVE PR4PERTIES,I�TC. (hereinafter"Wave"). <br /> WHEREAS, Brandon is the Se11er of the following described real estate to <br /> Watkins: <br /> All that part of Lots 2Q,2I,22, 23, and 24 in Black 1 of EB Durfees Third <br /> Addition to the City of Decatur, as per Plat recoxded in Bool�22 at page 636 of <br /> the records ir�the Recorder's Office of Macon County,Illinais,lying North and <br /> East of tha Railraad Right of way. Situated in Macon County,Illinois. <br /> PIN: Q4-12-i0-378-026. <br /> WHEREAS,the City af Decatur has agreed to sell the alley immediately north of <br /> the Brandon-Watkins property and generally described as follaws: <br /> All that part of the 20-foot wide alley running East and West through Block 1 af <br /> E.B. Durfee's Third Addition to the City of Decatur,lyzng East of the right-of- <br /> way of the P. D. &E.Railroad, as per Plat recorded in Book 22 at page 636 of the <br /> records in the Recorder�s Off ce of Macon County,Illznois. <br /> WHEREAS, Wave is the owner of the real estate immediately north of and <br /> adjacent to such alley and has agreed to purchase such all.ey from the City of Decatur, <br /> and Brandon and Watkins have indicated thev are not interested in purchasing said alley. <br /> NOW THEREFORE,for and in consideration of the mutual prornises contained <br /> herein,the parties�iereto agree as follows; <br /> 1. Brandon as the owner of the real estate immediately south of the above- <br /> descrzbed alley does hereby waive any x�ght ta purchase a.ny portion of the alley and <br /> waives any right to claim any interest in said alley if it is vacated by the City of Decatur. <br /> 2. Watkins as the buyex under the Contract for Deed of the immediately <br /> south of the above-described alley does hereby waive any right to purchase any portion of <br /> the alle��and waaves any right ta claim any interest in said a11ey if it is vacated by the <br /> City ofDecatur. VVave ab ees Watkins sha11 have no obligation to move an existing <br /> fence if such fence is located on the alley. <br />
