An easement for the vacated alley shall be maintained for utilities. <br /> 2. The alley must be xnaintained in a condition consistent with the remainder of the property. <br /> The City Plan Commission voted 6-0 to recommend approval of this petition at the March 7,2019 meeting;the meeting minutes <br /> are attached. <br /> BACKGROUND: <br /> On April 15,2019,Ordinance 2019-18 was approved but with an incorrect legal description for the subject properiy <br /> inadvertently included.As a result,the ardinance has to be repealed and another ordinance with a proper legal description would <br /> have to be approved. The petitioner is requesting vacation of an alley running east-west,located south of 800 Block of West King <br /> Street between North Uan Dyke Street and North Pine Street. The alley has a width of 20 feet and has a length of 264 feet,with a <br /> total area of 5,156 square feet. <br /> The City of Decatur has no known future plans for the subject site,and Department of Public Works has no issue with this <br /> vacation. The vacation will enable the petitioner to control the existing alley and utilize the area as part of the property. <br /> The proposed alley to be vacated has an estimated market value of$1,300.00 which will be paid to the City. A second appraisal <br /> is not required.
