<br /> to ensure that applicants are employed, and that emp{nyees are fireated during

<br /> 5uch action shal{include,but not be lirnited to,the fallowing:emplayment,upgrading,
<br /> demotian or transfer, recruitment or recruitment advertising, layoff ar termination;

<br /> apprenticeship. in addition, the Bidder agrees to comply with any implementing

<br /> b. Age - In accordance with section 4 of the Age Discrimination in Employment Act of
<br /> 1967, as amended, 29 U.S.C. § § 623 and Federal transit law at 49 U.S.C. § 5332, the
<br /> Bidder agrees to refrain frnm discrimination against present and prospective
<br /> employees fo�- reason af age. In addition, the Bidder agrees to comply with any
<br /> implementing requirements FTA may issue.
<br /> c. l7isabilities- ln accordance with section 102 of the Americans with Disabilities Act, as
<br /> amended, 42 U.S.C. § 12112, the Bidder agrees that it will camply with the applicable
<br /> requ'srements c�f U.S. Equ�) Err�ploymenfi Opportunity Commission, "Regulations tt�
<br /> Implement the Equal Employment Provisions of the Americans with pisabilities Act,"
<br /> 29 C.F.R, Part 1630, pertainingto employm�nt of persons with disabiEities. l�t addition,
<br /> the Bidder agrees to comply with any implementing requirements FTA may issue.
<br /> 3. The Bidder also agrees to include these requirements in each subcontract financed in
<br /> who(e or in part with Federal assistanee provided by FTA, madified only if necessary to
<br /> identify the affected parties.
<br /> Disadvantaged Business Enterprise (DBE) Participatian
<br /> The Bidder must compiy wifih the DBE pragram requirements of 49 C.F.R. part 26.The Bidder
<br /> shall nat discriminate based on race,color, national origin,or sex in the performance of the
<br /> contract. The 8idder shai) carry out applicable requirements of 49 C.F.R. part 26 in the award
<br /> and administration of DQT assisted contracts. Failure by the Bidder ta carry out these
<br /> requirements is a material breach of the contract, which may result in the termination of the
<br /> contract ar such other rernedy as the reeipient deems apprapriate,which may ir�clude, but is
