Tire Lease r�gteement IFB L7PTS 2019-02 <br /> uncier the �obbying Disdc�sure Act af 2995 who has made lobbying contacts on its beFsalf with <br /> non-Federal funds wifih respect to that Federai eontract, grant or award cavered by 31 U.S.C. � <br /> 1352. <br /> Cargo �referenee <br /> The Contractor agrees to use privately awned United States-Flag commerciai vessels to ship at <br /> least St}percent of the gross tonnage (camputed for dry bulk carriers, dry cargo iiners, and <br /> tankersa involved, whenever shipping any equipment, material,or carnmodities pursuant to the <br /> underiying cantract ta the extent such vessels are avaiiable at fair and reasonable rates for <br /> United States-Fiag commercial vessels; and to furnish Uvithin 20 work'sng days foilowing the date <br /> of loading far shipments originating within the United ��ates or within 30 working days <br /> foElowing the date of loading for shipments ariginating outside the United States, a legible coPY <br /> vf a rated, "on-board" commercial acean bill-of-lading in �nglish for each shipment of cargo <br /> described in the preceding paragraph to the �3ivision of Nationai Cargo, Office of Market <br /> Development, Maritime Administration, Washingtan, DC 2059p and to the FTA recipient <br /> {through the contractor in the case of a subcantractar's bill-of-lading); and to inciude these <br /> requirements in all subcontracts issued pursuant to this cantract when the subcantract may <br /> involve the transpart of equipment, materiai, or comrr�odities by ocean vessei. <br /> Fly America <br /> The Sidder agrees ta comply with 49 U.S.C.4C}138 {the"Fly America"Act}in accordance with tt�e <br /> General Services Administration's regulations at 41 C.F.R. Part 301-10, which pravide that <br /> recipients and sub �ecipients of Federal funds and theic contractors are required ta use U.S. Flag <br /> air carriers for US. governrnent-financed internatianal air travel and transportatian of their <br /> personal effects ar praperty, to the ext�nt s�ch service is available, esr�less travel by foreign air <br /> carrier is a matter of necessity, as defined by the Fly America Act. The Bidder shall submit, if a <br /> foreign air cacrier was used, an apprapriate certifscation or rt�emorandurr�adequately explaining <br /> why service by a U.S. flag air carrier was not available ar why it was necessary to use a foreign <br /> air carrier and shall, in any event, provide a certi€icate of compliance with the Fly America <br /> requirements. The Bidder agrees ta include the requirements of this section in all subcontracts <br /> that rr�ay invafve international air transpartatio�. <br /> 17 <br />
