ORDINANCE NO. �d f q"� 4� <br /> ORDINANCE EXTENDING A TEMPORARY MORITORIUM ON THE <br /> ENFORCEMENT OF CHAPTER 48 SECTION 8 WEEDS <br /> WHEREAS, the City of Decatur is a home rule unit of local government pursuant to <br /> Article VII, Section 6 of the Constitution of the State of Illinois, 1970 and may exercise any <br /> power and perform any function pertaining to its government and affairs, including the <br /> regulation of nuisances, weeds, grass or other underbrush; and, <br /> WHEREAS, on July 15, 2019, via Ordinance 2019-76, City Council approved in essence <br /> a temporary moratorium on enforcement of high grass nuisances (City Code Chapter 48 Section <br /> 8 Weeds)till (i) August 28, 2019; or (ii)the date City Council repeals this Ordinance; and, <br /> WHEREAS, staff initiated research on the subject matter and ordinances of other <br /> communities, as well as convened an ad-hoc study group with various interested organizations <br /> represented; and, <br /> WHEREAS, staff has made good progress, additional time is needed to continue research <br /> and work on a draft ordinance based on the group discussion, prior to further discussion and <br /> feedback by the group and forwarding a recommended ordinance to the City Council. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS, as follows: <br /> Section 1. That the above recitals are hereby declared to be true and correct findings of <br /> the City Council of the City of Decatur and are incorporated herein. <br /> Section 2. That an extended temporary moratorium on the enforcement of City Code <br /> Chapter 48 Section 8 and prosecutions pursuant to said City Code is hereby placed for those <br /> properties that claim to have authentic native iandscaping or prairie grass landscaping. <br /> Section 3. That this extended temporary moratorium shall be effective until the earlier of <br /> the following: (i) October 31, 2019; or (ii) the date that City Council repeals this Ordinance. <br />
