APPOINTMENTS FROM ELIGIBLE REGISTERS. A. Department directors, as appointing officers, are authorized to appoint any candidate for any non-promotional classified position with the City who is placed on the eligible register for such position by the Civil Service Commission, without regard to the rank of said person on such register. Except as the provisions of Sections 18 through 23, inclusive, are applicable to the City Manager, the power and authority of the Civil Service Commission to make rules shall apply thereto to carry out the purpose and intent thereof, but no rule contrary to or in conflict with said provisions shall be made. 25. DEFENSE AND INDEMNITY. Except for gross negligence, willful and wanton conduct or criminal misconduct, if any claim or action is instituted against an officer,employee or member of a board, commission or committee of the City, or a former officer, employee or member, based upon an injury allegedly arising out of an act or omission occurring within the performance of the duties on behalf of the City of such officer, employee or member, provided notice of such claim or action is given to the City Clerk within a reasonable time, the City, at it's option, shall do or cause to be done,one or more of the following: (a) Appear and defend against said claim; (b) Indemnify such officer, employee or member for the cost and expense of defending against such claim or action;
