URDINANCE NO.2019- ��a AN ORDINANCE AMENDING CITY CUDE tJF THE�ITY OF DECATUR,ILLINfJIS BY THE ADDITION C1F CHAPTER 52.2 -FROHIBITING CANNABIS BUSINESS ESTABLISHMENTS- WHEREAS, the City af Decatur, Illinois, an Illinais municipal carporation, has the authority to adapt ordinances and to promulgate rules and regulations that pertain to its governrnent and affairs and that protect the public health, safety and welfare of its citizens; and, WHEREAS, on June 25, 2019, the State of Illinois adopted the Cannabis Regulation and Tax Act("Act°'}as Public Act 101-4427;and, WHEREAS,this 4rdinance is adopted pursuant to the prauisions c�f the Act,Sectian 55- 25(S),which provides that the City af Decahu has the authority to enact ardinances to prohibit or significant�y limit a Cannabis Business Establisllment's lacation;and WHEREAS, the City af Decatur has determined that the aperation of Can��abis Business Establishrnents would present adverse irnpacts upc�n the health,safety and welfare of the residents, and additional cc�sts,burdens and impacts upon law enfarce�nent and regulatory operations of the City of Decatur; and, WHER.EAS, the Corporate authorities of the City of Decatur in exercise of the power reserved to them under the Act desire to adopt certain regulations to prohibit the location af Cannabis Business Establishments within the City of Decatur. NOW, THEREFORE, BE IT t7RDAINED by the City Council of the City nf Decatur as failows: Section 1. The facts and statements contained'tn the preamble to this Ordinance are found to be true and correc#and are hereby adopted as part of this Ordinance. Sectian 2. That the City Gode af the City af Decatur be, and the same is hereby madified and amended by adding a new Chapter 52.2 titled"Cannabis Business Estabiishrnents Prohibited" thereto. Said new Chapter 52.2 shali provide as se#forth in Exhibit A attached hereto and made a part hereof. Sectian 3. That the City Clerk be, and she is hereby, authorized and directed to cause the pravisions hereof to be appropriately set out in the City Code and to cause the same to be published in pamphlet form according to law.
