BACKGROUND: DPS #bl is seeking to utilize Decatur's city-wide fiber network to provide high speed computer connectivity between thernselves and the ICN point of presence located at RCC to take advantage of internet access bandwidth being offered by the ICN at no charge to public K 12 schoals. This IRU Agreement gives DPS#61 the right ta use twa strands of City Fiber for an initial term of 20 years and further demands up-frant payment for the right to use ihese dark fibers in addition to an armual fiber maintenance fee. DPS#61 is paying to use the fiber only,no electronics is pravided in this agreernent. This is a great opportunity for tl�e City of Decatur to callaborate with the School District atul in tum affset some of the city's e�enses with its city-wide fiber netwark. The city fiber DPS #61 plans ta use is already in place and no fizrther fiber constructian is reyuired. DPS #61 has already obtained approval to move fon�ard with this project and has signed the attached IRU agreement and associated sales order. After Decatur City Council approval,the fiber will be turned aver DPS#61 for testing and acceptance. The up-front paynnent of$13,790 as described in the TRU Agreement is due and payable when this ageernent is signed by both Parties,received,and filed by fhe City of Decatur. The annual maintenance fee of$460.80 will bc due and payable when DPS #61 begins using the fiber. PRiOR COUNCIL ACTION: City Council has approved other IRU Agreements with Millikin University and the Central Illinois Regional Dispatch Center in the past.
