EQUIPMENT The Contractor shall provide a minimum of 5 radio dispatched towing vehicles, from a manned dispatch point base station, on a 24 hour, 7 day a week basis. The Contractor shall provide a minimum of 5 wreckers for the snow emergency route towing upon 5 hours notification. The Cantractor will have at least one wrecker capable of towing commercial vehicles of fully loaded maximum road weight. Also, a flatbed trailer must be available to transport vehicles incapable of being towed. The Contractor shall provide to the City, at the times agreed to by the parties with at least 24 hours notice to Contractor, 4 wreckers and 4 drivers for the "Street for Storage" system currently in use by the City. Both parties agree to reasonably conform the requirements of this portion of the agreement to achieve a workable, agreeable system for both parties. COMPLAINTS • The Contractor shall provide a consumer complaint procedure in reference to towing, storage fees, and damage/loss clairns which is satisfactory to the Police Department. Cornplaints received by the successful Contractor shall be forwarded to the Decatur Police Department and the Decatur Police Department shall provide complaints received regarding the successful Contractor to said Contractor. T'he Contractor shall provide a consumer complaint form, which must be acceptable to the Decatur Police Department. RESPONSE The Contractor shall provide for wrecker response time to average no longer than 20 minutes with a maximum response time to be 30 minutes subject to reasonableness, and subject to • circumstances beyond the control of the Contractor, acts of God etc. It is the understanding that City requested tows shall take priority over other tows of Contractor. CANCELLATION OF TOW SERVICE After receiving a request for towing service, such request may be canceled at any time by the Decatur Police Department, or the owner, or authorized agent of the owner of the vehicle requested to be towed. If such request for cancellation is made prior to any portion of the Contractor's equipment being physically attached to the vehicle to be towed, then Contractor shall not charge anyone for service. If such request for cancellation is made subsequent to any portion of Contractor's equipment being physically attached to the vehicle to be towed, then the Contractor shall be allowed to charge for an attachment (hook-up) service even if, for any reason, said vehicle is not actually towed.
