RESOLUTION NO. R2020" �� <br /> RESOLUTION AUTHORIZING WAIVING OF <br /> FINES, FEES,PENALTIES OR COSTS FOR VIOLATIONS <br /> OF CITY CODE CHAPTER 34-TRAFFIC AND PARKING <br /> WHEREAS, the City of Decatur, Illinois, ("City") is a home rule municipality under the <br /> Constitution and laws of the State of Illinois; and, <br /> WHEREAS, the City has, pursuant to its authority granted under the Constitution and <br /> laws of the State of Illinois as a home rule authority, enacted provisions regulating traffic and <br /> parking on municipal and other property; and, <br /> WHEREAS, City Code sets forth fines, fees, penalties and costs for violations of the <br /> regulations set forth for traffic and parking in the City; and, <br /> WHEREAS, Chapter 34 of the City Code provides for increased fees, penalties and <br /> costs for citations that are not paid in a timely and directed period; and, <br /> WHEREAS, the enforcement of the traffic and parking regulations of the City and the <br /> collection of the fines, fees, penalties and costs for violations of the traffic and parking <br /> regulations is an expense incurred by the City; and, <br /> WHEREAS, the City has an interest in temporarily reducing the costs for the collection <br /> of the fines, fees, penalties and costs for traffic and parking regulations and in encouraging <br /> persons in violation to pay the fines, fees,penalties and costs incurred. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Decatur as <br /> follows: <br /> Section 1. That for parking citations issued for violations of traffic and parking <br /> regulations set forth in Chapter 34 of the City Code, the fees, penalties and costs assessed in <br /> excess of the original penalty or fine amount shall be waived if the citation amount is paid on or <br /> before April 30, 2020. <br /> Section 2. That the waiver of the fees, penalties and costs provided for in Chapter 34 <br /> shall be in effect beginning from the effective date of this Resolution and shall expire at 5:00 <br /> p.m. on April 30, 2020. <br /> Section 3. That the fees, penalties and costs provided for in Chapter 34 shall be in full <br /> force and effect on May l, 2020. <br /> Section 4. That this Resolution temporarily waiving fees, penalties and costs for traffic <br /> and parking citations shall not apply retroactively and shall not permit the return or refunding of <br /> any fees,penalties and costs previously paid. <br />
