SUMMARY RECOMMENDATION: It is recommended by City staff that the City Council approve the attached resolution authorizing the Mayor to execute an agreement between the City and Jimmie Soules Bird Repelent Company for the control of birds in downtown Decatur for a period of three years beginning October 1,2020 through September 30,2023 for an amount not to exceed$75,000.00. BACKGROUND: The City's current three-year agreement with the Jimmie Soules Bird Repelent Company, approved by the City Council on September 18, 2017, expires on September 30, 2020. This agreement is for the control of birds in the City's downtown area. The downtown area is described in the agreement as being the area bounded by Cerro Gordo on the north,Martin Luther King on the east,Wood Street on the south and Church Street on the west.The purpose of controlling the birds is to minimize the health-related problems,cleanup costs and nuisances that can be associated with high numbers of birds flocking or roosting in the area. City Staff has met with Mr. James Soules to discuss a new agreement for these services. Soules' bird repellent process is proprietary and has proven extremely effective in keeping birds from infesting high use areas downtown over the years. Birds are not harmed by his procedures. A new three-year agreement(copy attached)has been prepared by staff and Mr. Soules for Council review and approval. The new Agreement will begin October 1,2020 and extend through September 30,2023. Payment is made annually for the year beginning October 1 and ending on September 30 of the following year. The fee for each year of the 3-year contract is$25,000.00. This agreement is administered by the City's Public Works Department. PRIOR COUNCIL ACTION: September 30, 2002—City Council approved Resolution R2002-188, authorizing Agreement with Soules Bird Repelent Company of Decatur, Illinois, for Bird Control Services in the Central Business District for a period ending September 30,2005. September 6, 2005 — City Council approved Resolution R2005-120, authorizing Agreement with Soules Bird Repelent Company of Decatur, Illinois, for Bird Control Services in the Central Business District for a period ending September 30,2008. October 20, 2008 — City Council approved Resolution R2008-177, authorizing Agreement with Soules Bird Repelent Company of Decatur, Illinois, for Bird Control Services in the Central Business District for a period ending September 30,2011.
