Exhibit A <br /> (Upon completion and execution by the parties,this document shall become a binding lease) <br /> CASH RENT FARM LEASE <br /> THIS LEASE is entered into by and between LANDOWNER,CITY OF DECATUR,by and through the LANDOWNER'S <br /> AGENT, FIRST ILLINOIS AG GROUP, and TENANT, LYNN CLARKSON, DBA CLARKSON FARM, 320 E. SOUTH <br /> STREET,P.O.BOX 80,CERRO GORDO,IL 61818-0080. <br /> THE LANDOWNER leases to the Tenant, for organic agricultural purposes only, the following described real estate (hereinafter <br /> "premises"),including the fixed improvements thereon: <br /> The leased premises limited to the tillable acreage located inside the Oakley Sediment Basin berms located in the North Half(N%z)of <br /> Section Two(2);and the Northeast Quarter(NE%.)of Section Three(3);all in Township Sixteen North(T 16N),Range Three East(R3E)of <br /> the Third Principal Meridian(31 P.M.),Oakley Township,Macon County,Illinois. Aerial photo attached identifying leased area. <br /> A)LENGTH OF TENURE: The terms of this Lease shall begin on the date of signing of this Lease and shall end the last day of February <br /> 2022,or after all the crops on the premises have been harvested,whichever occurs first. <br /> B)RENT AND TIME OF PAYMENT: The Tenant agrees in lieu of paying cash rent to till,incorporate organic fertilizer,and plant <br /> cereal rye.The cereal rye will be harvested as seed in the summer of 2021. Clover will be seeded into the cereal rye in February 2021. <br /> If the Tenant has not seeded a crop by May 31,2021,Landowner may terminate this Farm Lease. Landowner is not obligated to reimburse <br /> Tenant for farming operations or crop inputs purchased. <br /> C)SOIL FERTILITY: Tenant shall apply and pay for,prior to planting this lease year,organic fertilizer. A paid fertilizer receipt to be <br /> provided to Landowner. <br /> D)LANDOWNER AGREES TO PAY THE FOLLOWING EXPENSES: <br /> 1. Taxes on premises and improvements owned or held by Landowner. <br /> 2. Materials the Landowner deems necessary for repairs and improvements on the above described premises. <br /> E)LANDOWNER WILL NOT PAY FOR THE FOLLOWING: The Landowner shall not be obligated to pay for any fertilizer, <br /> limestone,seed,chemicals,soil testing,machinery,power or labor,except skilled labor required to make repairs or improvements as <br /> expressly approved by Landowner. <br /> F)TENANT SHALL HAVE THE FOLLOWING DUTIES IN OPERATING THE PREMISES: <br /> 1. To cultivate the premises faithfully and in a timely,thorough and businesslike manner. <br /> 2. To keep premises neat,and to prevent any unnecessary waste,damage,or soil erosion. <br /> 3. Not to allow noxious weeds to go to seed on said premises,but to destroy same <br /> 4. To keep open ditches,tile drains,tile outlets,grass waterways,and terraces in good repair. To preserve established watercourses or <br /> ditches and to refrain from any operation that will injure them. <br /> 5. Not to burn corn stalks,cobs,straw or other residue grown on the premises without landowner permission. <br /> 6. To clip small grain stubble and to prevent noxious weeds from going to seed. <br /> 7. To follow such crop rotation,tillage practices,organic fertilizer,herbicide and insecticide programs,conservation measures,and <br /> arrangements as are worked out with the Landowner or his Agent. Landowner is not liable for the cost of over application of organic <br /> fertilizer,limestone,herbicide,and/or insecticide. <br /> 8. To comply with pollution control and environmental protection requirements,and to implement soil erosion control practices. <br /> 9. To use prudence and care in transporting,storing,handling,and applying all organic fertilizers,pesticides,herbicides,and similar <br /> substances.To read and follow instructions on the labels for the use of such materials in order to avoid injury or damages to persons or <br /> premises or both on the leased premises and adjoining areas. To comply with all applicable federal, state and local statutes, <br /> regulations,rules and ordinances. <br /> 10. Not to cut,bulldoze,damage or destroy(or permit any such damage or destruction)of trees without written permission ofLandowner. <br /> 11. Not to permit,encourage,or invite other person or persons to use any part or all of the premises for any purpose or activity not directly <br /> related to its use for agricultural production,including hunting. <br /> 12. Not to either dispose of solid waste or permit others to dispose of solid waste on the premises. <br /> 13. Not to store chemicals on the premises. <br /> 14. To certify all acres planted and production harvested from the premises each year in compliance with the Government Program in <br /> effect at that time as required by the Farm Service Agency and provides a copy of certification to Landowner. <br /> 15. Not to use synthetic pesticides or fertilizers. <br /> 1 <br />
