III. GENERAL COMPLIANCE WITH APPLICABLE LAWS: SUBRECIPIENT agrees to comply with <br /> the requirements of Title 24 of the Code of Federal Regulations, Part 570(HUD regulations <br /> concerning CDBG) and 2 CFR Part 200 of Uniform Administrative Requirements, Cost <br /> Principles and Audit Requirements. <br /> SUBRECIPIENT also agrees to comply with all other applicable Federal, state, and local <br /> laws, regulations, and policies governing the funds provided under this agreement. <br /> SUBRECIPIENT additionally agrees to comply with any changes issued to the CITY'S CDBG- <br /> CV Small Business Assistance program by HUD. SUBRECIPIENT understands that changes <br /> issued to the CITY'S CDBG-CV program by HUD may materially alter the terms of this <br /> Agreement. The CITY will distribute any amendments to the CDBG-CV programs within <br /> thirty (30) days and SUBRECIPIENT must acknowledge the receipt. <br /> SUBRECIPIENT acknowledges and affirms that the SUBRECIPIENT has the organizational <br /> capacity to adhere to collection and reporting requirements, regarding performance <br /> measures, as required by Uniform Administrative Requirements, Cost Principles, and <br /> Audit Requirements for Federal Awards; Final Rule ("Omni Circular") Subpart D, Sections <br /> 200.300-200.303. Such performance measures shall be decided upon by the <br /> SUBRECIPIENT and the CITY'S Director of the Community Development Department or <br /> the Neighborhood Services Manager, based on the requirements outlined by HUD for the <br /> category of eligible activities that the SUBRECIPIENT'S program engages in. These <br /> categories have been described within HUD's "Community Development Block Grant <br /> Program: Guide to National Objectives& Eligible Activities for Entitlement Communities," <br /> and the Guide shall be incorporated hereto by reference, and will be provided to the <br /> SUBRECIPIENT. Organizational capacity shall be demonstrated by various methods, <br /> including but not limited to: <br /> • Use of OMB-approved standard information collections when providing financial <br /> and performance information; <br /> • Financial data is provided for performance accomplishments of the Grant award; <br /> • Cost information shall be distributed to demonstrate cost effective practices; <br /> • SUBRECIPIENT shall provide the City with the same information required by the <br /> Federal awarding agency under sections 200.301 and 200.210; and <br /> • All expenditures shall be accounted for, in compliance with requirements under <br /> section 200.302, as is interpreted by the CITY'S Director of the Community <br /> Development and /or Neighborhood Services Manager. <br /> SUBRECIPIENT agrees to follow either the procurement guidelines set forth in Section <br /> 200.320 of the Omni Circular, or the procurement guidelines/standards which the <br /> SUBRECIPIENT uses during its normal course of business; whichever of the two <br /> guidelines is more restrictive.
