It serves the daycare needs of families in the <br /> area. <br /> The second standard is "designed, located, and proposed to be operated that the public health, <br /> safety and welfare will be protected."The subject property is located on an arterial street with easy <br /> accessibility. The proposed use will also meet the second standard since there are two employees <br /> (one (1) full time and one(1)part time)to help care for these children. At this time, the petitioner <br /> has not obtained a State License but is planning to in the near future. This daycare is located and <br /> designed to be operated in a manner in which the public health, safety and welfare will be <br /> protected. <br /> The third standard is the proposed"will not cause substantial injury to the value of other property <br /> in the neighborhood in which it is to be located.". The daycare use will be required to meet all <br /> applicable City building and Fire codes, as well as all requirements imposed by the State in the <br /> issuance of a home day care license. The petitioner also plans on constructing a fence (in <br /> December)on the east side of the property(Area B-1)in order to protect and allow the children to <br /> have more outdoor activities. <br /> STAFF RECOMMENDATION <br /> 1. Staff recommends approval of the conditional use permit as submitted with the following <br /> conditions: <br /> a. That the proposed operation will not be allowed to exceed the maximum number of <br /> children allowed by the State of Illinois. <br /> b. The hours of operation will be Monday through Friday 6:00 a.m. to 6:00 p.m. <br /> c. That the proposed operation be in compliance with applicable provisions of the City's <br /> adopted Building Codes, including obtaining a building permit to perform any proposed or <br /> required improvements to the existing dwelling. <br /> d. That the proposed daycare be appropriately licensed by the State of Illinois at all times. <br /> The petitioner shall supply the City with a copy of the daycare license. <br /> PLAN COMMISSION ACTION <br /> Section XXII.A.2. requires the Plan Commission to hold a public hearing on a Conditional Use <br /> Permit request, and then forward its report and recommendation to the City Council for final <br /> approval.
