The NPDES permit protects the environment from pollutants by controlling the
discharge and quality of the stormwater runoff.
In 2008,the City,Macon County,Forsyth,and Mt.Zion entered into a Memorandum of Understanding(MOU)with the Macon
County Soil and Water Conservation District(MCSWCD)to collect the inspection fees, provide education and complete the site
inspections for site developers and builders. In 2020,the MCSWCD elected to stop providing construction site inspection services
as detailed in the 2008 MOU.
The proposed Intergovernmental Agreement(IGA)is an update to the 2008 MOU removing the site inspection and continuing the
other services, which include education and website hosting, both are required to be completed by each community's NDPES
permit. Additional benefits include a shared website, reduced staff time, and it provides the opportunity for larger events due to
the additional resources of the group. The cost to the City is$1,000 per year which is paid by all those taking part in the
Agreement.
PRIOR COUNCIL ACTION:
• February 2,2006—The Storm Water Ordinance was presented to the City's Planning Commission who gave the
ordinance a favorable recommendation.
• February 21,2006-Council met in Study Session to discuss a Storm Water Ordinance, which would replace Chapter 38,
Soil Erosion.
• March 6,2006-Council approved Ordinance No. 2006-13,amending City Code Chapter 38,Storm Water Ordinance.
• November 3,2008-Council approved Resolution No. 2008-184 authorizing a memorandum of understanding between
the MS4 group and Macon County Soil and Water Conservation District to assist the community to meet the requirements
of the NPDES permits.
• January 18,2011—Council approved Ordinance No.2011-04,amending City Code Chapter 38, Storm Water Ordinance
to add land disturbance permits as required by the phase II requirements of the City's NPDES permit for a stormwater
system.
• April 22,2014—Council approved Ordinance No.2014-14,amending City Code Chapter 38, Storm Water Ordinance to
add the stormwater utility.
https://decatur.novusagenda.com/AgendaWeb/CoverSheet.aspx?Item ID=3222 1/2
