ORDINANCE NO. �Da( — 08 <br /> ORDINANCE AUTHORIZING ACCEPTANCE OF CERTAIN PROPERTIES OF <br /> MACON COUNTY TRUSTEE FOR PUBLIC PURPOSE <br /> WHEREAS, the City ("City") and County of Macon ("County") are units of local <br /> government as defined by Article VII, Section 1, of the Constitution of the State of Illinois; and, <br /> WHEREAS, the City and County are authorized and empowered by Article VII, Section <br /> 10 of the Constitution and the Intergovernmental Cooperation Act(5 ILCS 220/1 et. seq.)to enter <br /> into Intergovernmental Agreements; and, <br /> WHEREAS,the County owns various parcels of land pursuant to the tax deed foreclosure <br /> process found in 35 ILCS 22/1-1 et. seq. more particularly described in Exhibit A attached hereto; <br /> and, <br /> WHEREAS, the County has attempted to sell these parcels at various public auctions and <br /> there remain many parcels that have not been purchased at these public auctions; and, <br /> WHEREAS, the City is a municipality with territory located wholly within the County; <br /> and, <br /> WHEREAS, the City desires to improve, revitalize and redevelop its neighborhoods and <br /> community and has determined that the properties owned by the County are an important portion <br /> of said improvement, revitalization and redevelopment with the goal to return the properties and <br /> parcels owned by the County to the tax rolls thus increasing the tax revenues for the City, County <br /> and various taxing districts; and, <br /> WHEREAS, the County has agreed to transfer under certain conditions the properties set <br /> out in Exhibit A to the City and the City has agreed to accept the properties under certain <br /> conditions. <br /> NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section 1. That the City declares that it is necessary and convenient for it to use, occupy <br /> and/or improve the property owned by the County as more particularly set out in Exhibit A for the <br /> making of public improvements and for the public purpose of improving, revitalizing and <br /> redeveloping the City. <br /> Section 2. That the City shall pay$150 per lot for those lots owned by the Macon County <br /> Trustee as set forth in Exhibit A. <br />
