STAFF REPORT <br /> Decatur City Plan Commission <br /> Hearing Date November 5, 2020 <br /> Case No. 20-42 <br /> Property Location North Mercer Street right-of-way north of West Eldorado Street <br /> Request Vacation of the sixty (60) foot Mercer Street right-of-way north of <br /> West Eldorado Street that abuts the petitioner's South property line. <br /> Petitioner Central IL Development Consortium <br /> Representative Chastain &Associates LLC <br /> BACKGROUND <br /> The petitioner is requesting vacation of a sixty (60) foot street right-of-way north of West <br /> Eldorado Street that abuts their South and West property lines. The vacation would enable <br /> Central IL Development Consortium and Mueller Company to control the Street ROW and <br /> utilize the area as part of the Mueller Company parking lot relocation project. The Street would <br /> be improved along with the rest of the property to the North and would serve as one of the <br /> entrances to the new Parking Lot. <br /> Surrounding Land Use and Zoning <br /> Direction Existing Land Use Zoning Comprehensive Plan <br /> Subject Property Street Right-of-Way M-1 Employment <br /> North Undeveloped M-1 Employment <br /> South Commercial B-2 Employment <br /> East Commercial M-1 Employment <br /> West Undeveloped M-1 Employment <br /> STAFF ANALYSIS <br /> The subject street right-of-way has a width of 60-feet and has a length of approximately 117-feet, <br /> with a total of 7,020-square feet. The petitioner owns the property on the north and west sides of <br /> the street to be vacated. <br /> Letters were sent to Ameren, Comcast Communications, and AT&T notifying the utility <br /> companies of the vacation proposal and no objections to the proposed right-of-way vacation with <br /> blanket utility easement were expressed. <br /> According to Paragraph 2.2.2 of the Administrative Policy & Procedure Manual: "All property <br /> owners with land abutting a piece of property which is under consideration for vacation shall be <br /> served proper notice prior to City Council action on the request." The only other adjacent <br /> property owner has been notified of the requested ROW vacation. Parallel parking and loading <br /> spaces will be provided along the east side of the vacated ROW to serve the adjacent building to <br /> the East. Also, Mueller will be providing the adjacent property owner Staff parking spaces in the <br /> new parking lot. A copy of the ingress/egress easement Plat for the benefit of the adjacent <br /> property owner is attached with this report and will be recorded after the ROW is vacated. <br /> The assessed value of surrounding vacant land was utilized to determine a market value per <br /> square foot to determine the land value for the Mercer St ROW. That land value is determined to <br />
