AGREEMENT BETWEEN THE PUBLIC SAFETY TRAINING FOUNDATION <br /> AND THE CITY OF DECATUR,ILLINOIS, <br /> FOR USE OF THE PUBLIC SAFETY TRAINING FOUNDATION'S FACILITIES <br /> This Agreement ("Agreement") is made by THE PUBLIC SAFETY TRAINING <br /> FOUNDATION, a not-for-profit corporation (the "PSTF"), and THE CITY OF DECATUR, <br /> ILLINOIS, a body politic and corporate under the laws of the State of Illinois, (the"City"), with <br /> reference to the following facts,and subject to the following terms and conditions: <br /> RECITALS <br /> A. The PSTF owns various training facilities in Macon County(the"Facilities"). <br /> B. The PSTF now desires to allow the Fire Department of the City ("DFD") and Decatur <br /> Police Department ("DPD") to use the Facilities, subject at all times to the terms and conditions <br /> of this Agreement. <br /> ARTICLE ONE—GENERAL TERMS <br /> A. In consideration for the City's covenants hereinafter expressed and made,the PSTF grants <br /> to the DFD and DPD non-exclusive access to and use of the Facilities on days exclusively <br /> determined by the PSTF. <br /> B. The City agrees that the PSTF shall maintain control of the Facilities and further agrees to <br /> abide by the PSTF operational rules for the Facilities, which rules and subsequent amendments <br /> shall be provided by PSTF personnel to the DFD and DPD personnel in charge. <br /> ARTICLE TWO—PARTICULAR TERMS AND CONDITIONS <br /> A. The Facilities are available to the City only for training of personnel employed by the DFD <br /> and DPD. <br /> B. The Facilities may be scheduled by DFD or DPD personnel by contacting the designated <br /> PSTF personnel. <br /> C. The DFD and DPD acknowledges that other parties will also be using the Facilities. <br /> D. DFD and DPD personnel shall use personal safety equipment at all times when training at <br /> the Facilities. <br />
