RESOLUTION NO. -010-7 <br /> RESOLUTION AUTHORIZING THE PURCHASE OF A TEMPORARY <br /> CONSTRUCTION EASEMENT ON PROPERTY OWNED BY THE NORFOLK <br /> SOUTHERN RAILWAY COMPANY FOR THE IMPROVEMENT OF BRUSH <br /> COLLEGE ROAD OVER FARIES PARKWAY AND THE NORFOLK SOUTHERN <br /> RAILROAD TRACKS <br /> CITY PROJECT 2009-33 <br /> SECTION 09-00933-01-BR <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DECATUR, <br /> ILLINOIS: <br /> Section 1. That the Mayor, City Manager, or their authorized designee, are authorized to <br /> execute the documents relating and necessary to acquire the following described property: <br /> Temporary Easement needed for Entrance Construction and Grading <br /> A part of the Norfolk Southern Railway Company Right of Way lying in the Southwest <br /> Quarter of Section 5, Township 16 North, Range 3 East of the Third Principal Meridian, and <br /> described as follows: <br /> Commencing at an Illinois Department of Transportation Brass Plug found at the southeast <br /> corner of the Southwest Quarter of said Section 5 per Monument Record recorded as <br /> Document 1894076 of the records in the Recorder's Office of Macon County, Illinois (N: <br /> 1164657.94, E: 828365.34); thence, along bearings reference to the Illinois State Plane <br /> Coordinate System,NAD83 (2011 Adjustment), East Zone, South 89 degrees 06 minutes 39 <br /> seconds West 265.13 feet along the south line of the Southwest Quarter of said Section 5; <br /> thence North 0 degrees 53 minutes 21 seconds West 33.31 feet to an existing easement and <br /> right of way per Book 2132,Page 336 of the records aforesaid and the Point of Beginning <br /> (N: 1164687.13, E: 828099.73); thence South 86 degrees 40 minutes 28 seconds West 46.38 <br /> feet along said existing easement and right of way; thence, continuing along said existing <br /> easement and right of way,northwesterly 369.94 feet along a curve to the right, said curve <br /> having a radius of 5,698.58 feet, the chord of said curve bears North 88 degrees 24 minutes <br /> 32 seconds West 369.88 feet; thence North 86 degrees 32 minutes 57 seconds West 27.01 <br /> feet along said existing easement and right of way; thence, continuing along said existing <br /> easement and right of way,northwesterly 597.87 feet along a curve to the left, said curve <br /> having a radius of 5,251.03 feet,the chord of said curve bears North 89 degrees 48 minutes <br /> 40 seconds West 597.55 feet; thence South 86 degrees 55 minutes 38 seconds West 424.60 <br /> feet along said existing easement and right of way; thence North 3 degrees 04 minutes 22 <br /> seconds West 10.00 feet(N: 1164685.53, E: 826634.66);thence North 86 degrees 55 <br /> minutes 38 seconds East 350.00 feet along a line 10.00 feet distant northerly of and parallel <br /> to said existing easement and right of way; thence North 3 degrees 04 minutes 22 seconds <br /> West 7.00 feet; thence North 86 degrees 55 minutes 38 seconds East 74.60 feet along a line <br /> 17.00 feet distant northerly of and parallel to said existing easement and right of way; thence <br /> southeasterly 599.81 feet along a curve to the right being concentric with and 17.00 feet <br />
