ORDINANCE NO. � <br /> ORDINANCE AMENDING CITY CODE <br /> -CHAPTER 73- <br /> - OFFENSES— <br /> BE <br /> OFFENSES—BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, <br /> ILLINOIS: <br /> SECTION 1. That Chapter 73 of the City Code of the City of Decatur, Illinois,be, and <br /> the same is hereby modified and amended by amending Sections 38 and 39, so that Sections 38 <br /> and 39 as so amended, shall provide as follows: <br /> 38. PROTECTIVE FACE COVERINGS REQUIRED. <br /> A. Required. <br /> 1. All persons within the municipal boundary of the City of Decatur shall <br /> be required to wear protective face coverings,which face coverings shall completely cover their <br /> mouth and nose, and be reasonably designed and made to inhibit, filter or restrict the passing of a <br /> person's breath, sneeze, cough or other exhaling from one's nose and mouth while in or on: <br /> (a) Any healthcare setting; <br /> (b) Any public transportation including,but not limited to,buses,planes, <br /> taxis or rideshares; <br /> (c) Any public transportation hub; <br /> (d) Any congregate facilities or setting; <br /> (e) Any school, day care setting and educational institution as required by <br /> the Illinois State Board of Education, Illinois Department of Children <br /> and Family Services, and the Illinois Department of Public Health. <br /> (f) Any public or private building,business or space as required by the <br /> owner or operator. <br /> 2. In addition to the requirements set forth in Section 38(A)(1) above, all <br /> persons within the municipal boundary of the City of Decatur who are not fully vaccinated, <br /> which is defined as two weeks after the second dose in a two-dose series of vaccine or two weeks <br /> after a single dose vaccine, engaging in any activity outside of their residence,while other <br /> persons are present, shall be required to wear protective face coverings,which face coverings <br /> shall completely cover their mouth and nose, and be reasonably designed and made to inhibit, <br /> filter or restrict the passing of a person's breath, sneeze, cough or other exhaling from one's nose <br /> and mouth when in a public place and unable to maintain a consistent six-foot social distance <br /> from others. <br /> B. Exceptions. Protective face coverings shall not be required, <br /> (1) For children under two years of age; <br /> (2) When engaged in physical activity such as walking or running while <br /> maintaining social distancing from others of not less than six feet; <br /> (3) When alone with members of the same household; <br /> (4) When eating or drinking, whether in public or private. <br /> Reasonable accomodations must be provided for those with a medical condition or disability that <br /> prevents the wearing of face coverings so long as doing so does not cause an undue hardship. <br />
