as of the Effective Date, franchise agreement with the City, including by the City for improvements
to, and extensions of, its own fiber network ("City Fiber") an interim map of which has been
provided to SiFi by the City. City may make changes to the planned locations of City Fiber up to
but no later than the date of first System design submittal by SiFi to City("Design Date")and City
will then provide SiFi with a final GIS map ("City Fiber Final Map") of the City Fiber as of the
Design Date. During this three(3)year period, SiFi agrees not to install cables and other portions
of its System in City Fiber locations in the Public Way as indicated on the City Fiber Final Map
for a period of(3)years from the date of this Agreement.
2.5 Efficient Permitting Process.
2.5.1 During the Term, the City shall provide expedited, and diligent
review of all applications for permits by SiFi and/or its contractors, to the
extent reasonably possible and to the extent permits are necessary, including
permits or other necessary items for construction work on the System within
the Public Way. The City acknowledges and agrees that in order for SiFi to
perform its obligations under this Agreement, time is of the essence in
connection with permitting, licensing, and approval of the System.
Accordingly, the City agrees to the process and timeframes below in
connection with all applications for permits by SiFi and/or its contractors in
connection with this Agreement:
(i) SiFi shall submit to the City permit applications for scheduled and
planned work for each work zone, improvements and extensions to their System in one
comprehensive document per permit application for each work zone. The City will issue
such permit for all of this work within sixty(60)days and may amend the permit prior to
issuance as required, unless there are significant infrastructure conflicts that require more
time to resolve, in which case the City will, in writing, provide an estimate of the
additional time required for the completion of review and issuance of permits.
(ii) Non-planned,emergency and no-notice repairs and alterations to the
SiFi System will be submitted on forms provided to the City for use in all utility work on
the public way and generally approved within five (5)business days.
