ORDINANCE NO. I— 4-1 <br /> ORDINANCE AMENDING CITY CODE <br /> - CHAPTER 54- <br /> -AMUSEMENT DEVICES— <br /> WHEREAS,the City of Decatur, Illinois, is a home rule unit of government and, <br /> pursuant to the provisions of Article VII, Section 6(a) of the Illinois Constitution may exercise <br /> any power and perform any function pertaining to its government and affairs, including,but not <br /> limited to, the power to tax and to incur debt; and <br /> WHEREAS,the Illinois Video Gaming Act("VGA"),230 ILCS 40/1 et seq.,regulates <br /> the operation, licensing, and administration of video gambling; and <br /> WHEREAS,the City of Decatur, in accordance with the VGA,regulates video gaming <br /> activity within the City of Decatur; and <br /> WHEREAS,pursuant to Article VII, Section 6(a) and Section 6(i)of the Ill. Const. of <br /> 1970 in conjunction with 65 ILCS 5/11-42-5 of the Illinois Municipal Code,the City of Decatur <br /> is authorized to impose a tax upon amusements; and <br /> WHEREAS, the City of Decatur now desires to impose a tax upon the amusement of <br /> playing a video gaming terminal within the City of Decatur("Push Tax"); and <br /> WHEREAS, the Mayor and City Council of the City of Decatur,hereby believe that it is <br /> in the best interest of the City of Decatur and its residents to impose said Push Tax; and <br /> NOW,THEREFORE,BE IT ORDAINED,BY THE CITY COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS,AS FOLLOWS: <br /> Section 1. That Chapter 54 of the City Code of the City of Decatur, Illinois,be, and the <br /> same is hereby modified and amended by amending Section 1, so that Section 1 as so modified <br /> and amended, shall provide as follows: <br /> CHAPTER 54 <br /> -AMUSEMENT DEVICES- <br /> 1. LICENSE. No person,firm or corporation shall operate,maintain or conduct a shuffle <br /> board, shuffle alley, bank board, coin operated pool table, coin operated bowling machine, coin <br /> operated baseball machine, gun or target type mechanical amusement device, video game or any <br /> other mechanical or electronic amusement device open to the public for hire or gain without first <br />
