CITY COUNCIL MEMORANDUM <br /> NO.2021- <br /> November 10,2021 <br /> TO: Honorable Mayor Moore Wolfe and City Council <br /> FROM: Scot Wrighton, City Manager <br /> Amy Waks,Assistant Corporation Counsel <br /> SUBJECT: Resolution Authorizing the Purchase of 1880 North Brush College Road for the <br /> Improvement of Brush College Road over Faries Parkway and the Norfolk <br /> Southern Railroad Tracks <br /> City Project 2009-33 <br /> Section 09-00933-01-BR <br /> RECOMMENDATION: It is recommended that City Council approve the Resolution authorizing <br /> the Mayor, City Manager, or an authorized designee to execute the documents related to the purchase <br /> of 1880 North Brush College Road for $242,000 of State Motor Fuel Tax funds to provide right of <br /> way for the improvement of Brush College over Faries Parkway and Norfolk Southern Railroad tracks. <br /> These funds will be reimbursed at 100%by a State of Illinois Jobs Now! grant. <br /> BACKGROUND: On August 7, 2017, the City entered into an agreement with Crawford, Murphy <br /> & Tilly, Inc. (CMT) to perform land acquisition services for the Brush College Road Improvement <br /> Project using Illinois Jobs Now! funds provided by the State of Illinois. On June 5, 20108, the City <br /> received the announcement of the award of a$25 million grant through the Illinois Competitive Freight <br /> Program for the Brush College/Faries Parkway Grade Separation Project. On July 6, 2020, City <br /> Council authorized legal proceedings for condemnation for the property located at 1880 North Brush <br /> College Road and a Complaint for Condemnation was filed in Circuit Court. On April 5, 2021, City <br /> Council approved quick take authority to acquire said property and on August 27,2021,the Governor <br /> signed Public Act 102-0624 authorizing quick-take proceedings. On August 30, 2021, a Motion for <br /> Immediate Vesting of Title was filed in the pending Circuit Court case. After negotiations, an <br /> agreement was made with the owner and tenant to sell the property to the City for$242,000. As part <br /> of the process, the City will be required to assist in the relocation of the owner and tenant of the <br /> property but those costs will not be known until the relocation is completed. <br /> POTENTIAL OBJECTIONS: There are no known objectors. <br /> INPUT FROM OTHER SOURCES: Crawford, Murphy, &Tilly, Inc. <br /> STAFF REFERENCE: Amy Waks,Assistant Corporation Counsel, at 424-2807. <br />
