CITY COUNCIL MEMORANDUM NO. 2021- November 10, 2021 TO: Honorable Mayor Moore Wolfe and City Council FROM: Scot Wrighton, City Manager Amy Waks, Assistant Corporation Counsel SUBJECT: RESOLUTION AUTHORIZING THE TRANSFER OF 4147 EAST FARIES PARKWAY AND 4000 EAST LOGAN STREET FOR THE IMPROVEMENT OF BRUSH COLLEGE ROAD OVER FARIES PARKWAY AND THE NORFOLK SOUTHERN RAILROAD TRACKS CITY PROJECT 2009-33 SECTION 09-00933-01-BR RECOMMENDATION: It is recommended that City Council approve the Resolution authorizing the Mayor, City Manager, or an authorized designee to execute the documents related to the purchase of 4147 East Faries Parkway and 4000 East Logan Street for$433,693 of State Motor Fuel Tax,funds to provide right of way for the improvement of Brush College over Faries Parkway and Norfolk Southern Railroad tracks. BACKGROUND: On August 7, 2017, the City entered into an agreement with Crawford, Murphy & Tilly, Inc. (CMT) to perform land acquisition services for the Brush College Road Improvement Project using Illinois Jobs Now! funds provided by the State of Illinois. On June 5, 2018, the City received the announcement of the award of a$25 million grant through the Illinois Competitive Freight Program for the Brush College/Faries Parkway Grade Separation Project. On April 5, 2021, City Council approved quick take authority to acquire said property and on August 27,2021,the Governor signed Public Act 102-0624 authorizing quick-take proceedings. On August 30, 2021, a Motion for Immediate Vesting of Title was filed in the pending Circuit Court case. After negotiations, an agreement was made with the owner, in exchange for transferring title to the property to the City,the City would deposit$433,693 in escrow with the Macon County Treasurer until final just compensation is determined. As part of the process,the City will be required to assist in the relocation of the owner of the property but those costs will not be known until the relocation is completed and the pending Circuit Court case is completed.
