RESOLUTION NO. R RESOLUTION AMENDING RESOLUTION R2021-87 CONCERNING PAYMENT TERMS FOR BODINE ELECTRIC CHANGE ORDER#2 ATTACHED AS EXHIBIT A WHEREAS, the City of Decatur desires to buildout and expand our fiber infrastructure; and WHEREAS, the Decatur Public School District received a State grant to fund a fiber project; and WHEREAS, both taxing bodies financially benefit from this project being added to the current open contract for fiber installation; and WHEREAS, the local contractor doing the project was the only bidder for the awarded contract; WHEREAS,the City of Decatur will make direct payments to Bodine for this work since they were the entity that bid this project and subsequently approved Change Order#2; WHEREAS,the Decatur Public School District has issued Purchase Order# 10221848 to reimburse the City of Decatur for the cost of Change Order#2; BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the Change Order#2 bid received for installing high-capacity fiber optic cable, IT Project 2021-09 presented herewith be, and it is hereby, received, and placed on file. Section 2. That the circumstances said to necessitate this change were not reasonably foreseeable at the time the contract was entered into and the change is germane to the original contract and that this change order is in the best interest of the City of Decatur. Section 3. That City Manager or his designee be, and is hereby, authorized and directed to execute a purchase order to Bodine Electric in a total amount not to exceed$680,000.
