Information Technology <br /> DATE: 11/15/2021 <br /> MEMO: 2021-11 <br /> TO: Honorable Mayor Julie Moore Wolfe and City Council <br /> FROM: James Edwards,Director Information Technology Department <br /> SUBJECT: Resolution Amending Resolution R2021-187 Concerning Payment terms for Bodine Electric Change Order#2 <br /> attached as Exhibit A <br /> SUMMARY RECOMMENDATION: <br /> City Staff recommends that City Council approve the attached Resolution accepting a change in payment terms for work <br /> previously approved by City Council by Resolution#R2021-187,Resolution Accepting Bodine Electric Change Order#2 <br /> related to the Original Bid for Underground Fiber Construction of Fiber Extensions. <br /> BACKGROUND: <br /> On October 4,2021,Resolution#R2021-187,Resolution Accepting Bodine Electric Change Order#2 related to the Original <br /> Bid for Underground Fiber Construction of Fiber Extensions was approved by City Council. The plan was for the School <br /> District to issue a Purchase Order directly to Bodine Electric for this work.After further investigation by the School District <br /> legal team,it was determined that since the School District did not Bid their portion of this project and was utilizing the Bid <br /> obtained by the City through a Change Order,the school district could not issue a Purchase Order directly to Bodine for this <br /> work. Instead,the School district has issued a Purchase Order to the City of Decatur in the Amount of$680,000 to repay the <br /> City for the work being completed by Change Order#2 and then the City of Decatur will issue a Purchase Order directly with <br /> Bodine Electric for this work. This resolution amends Resolution#R2021-187 which changes the payment terms for this portion <br /> of this project. <br /> PRIOR COUNCIL ACTION: <br /> On April 19,2021,Resolution#R2021-73,Resolution Accepting Bid from Bodine Communications for Underground Fiber <br /> Optic Installation Throughout the City of Decatur. <br /> On April 19,2021,Resolution#R2021-74,Resolution Authorizing an Intergovernmental Agreement for the construction and <br /> installation of extensions to the City Fiber Optic Network to various School District Properties located on Rights of Way <br /> between the City of Decatur and the Decatur Public School District. <br /> On October 4,2021,Resolution#2021-187,Resolution Accepting Bodine Electric Change Order#2 related to the Original Bid <br /> for Underground Fiber Construction of Fiber Extensions. <br /> POTENTIAL OBJECTIONS: None anticipated <br /> INPUT FROM OTHER SOURCES: None <br /> STAFF REFERENCE: James Edwards,IT Director <br /> BUDGET/TIME IMPLICATIONS: <br /> There will no impact to the City Budget for this action. Bodine Electric will bill The City of Decatur for this work and in turn <br /> the City of Decatur will bill the School District for reimbursement of the same amount.
