REAL ESTATE PURCHASE CONTRACT AGREEMENT <br /> Unimproved Land <br /> THIS AGREEMENT("Agreement")is entered into by and between the City of Decatur,Illinois,an <br /> Illinois municipal corporation("City")and CASA Development LLC("Buyer"). <br /> RECITALS <br /> A. The City is a municipal corporation as set forth in the Illinois Municipal Code,65 ILCS 5/1-1-1,et. seq. <br /> B. The City is a home rule unit under Article VII Section 6(a)of the Illinois Constitution(IL Const. 1970, <br /> Art.VII,Sec. 6(a)). <br /> C. The City owns property that is undeveloped and adjacent to Lake Decatur. <br /> D. The City Council has determined that the property is no longer needed for any public purpose. <br /> E. The City Code of the City of Decatur provides in Chapter 33 that the City may dispose of property as the <br /> Council authorizes or approves. <br /> F. The City desires to transfer to Buyer the property set forth in this Agreement. <br /> G. The Buyer desires to purchase from the City the property set forth in this Agreement. <br /> NOW,THEREFORE,in consideration of the foregoing recitals,the mutual covenants and agreements <br /> hereinafter set forth,and for good and valuable consideration,the receipt, sufficiency and adequacy of <br /> which are hereby acknowledged,the parties agree as follows: <br /> 1. The foregoing recitals are incorporated herein as fully stated as a part of this Agreement. <br /> 2. The City of Decatur,Illinois,as Seller,agrees to sell and CASA Development LLC,or entity they <br /> control,as Buyer,agrees to purchase at the price of$33,976.00 the following legally described real estate <br /> premises("Property")situated in Macon County,Illinois: <br /> That part of the Southeast 1/4,of Section 25,Township 16 North,Range 2 East of the Third Principal <br /> Meridian,Macon County,Illinois,described as follows: <br /> Beginning at an existing iron pin marking the Northwest corner of Lot 36,Brook's Meadow Park Second <br /> Addition,as per Plat recorded in Book 982,page 65 of the Records in the Recorder's Office of Macon <br /> County,Illinois;thence S.9°57'23"E.-135.00 feet along the West line of said Lot 36 to an existing iron pin; <br /> thence S.9°45'12"E.-68.06 feet along the West line of said Lot 36 to an existing iron pin marking the <br /> Southwest corner thereof,thence S.9°45'12"E.-185.37 feet along the Southerly extension of the West line of <br /> Lot 34 of said Brook's Meadow Park Second Addition to a point on an existing cast iron sea wall;thence <br /> N.49027'37"W.-25.52 feet along said sea wall;thence N.33°33'29"W.-50.10 feet along said sea wall;thence <br /> N.9004'26"E.-44.97 feet along said sea wall to an iron pin set;thence S.83°46'19"W.-47.45 feet to an iron <br /> pin set; thence S.68019'54"W.-69.85 feet to an iron pin set;thence N.68°22'25"W.-28.83 feet to an iron pin <br /> set;thence N.33°19'46"W.-24.20 feet to an iron pin set;thence N.9°2947"E.-58.26 feet to an iron pin set; <br /> thence N.21°48'40"E.-83.25 feet to an iron pin set;thence N.28°20'56"E.-57.56 feet to an iron pin set; <br /> thence N.18°09'52"E.-59.81 feet to an iron pin set;thence N.6052'30"E.-36.82 feet to an iron pin set on the <br /> Westerly extension of the North line of said Lot 36;thence N.87°52'10"E.-35.00 feet along said Westerly <br /> extension of the North line of said Lot 36 to the point of beginning,containing 0.78 acres,more or less. <br /> i <br />
