principles to account for value added to the Premises upon completion of future phases and to
<br /> account for the length of any renewal terms. G&H shall provide City and DPD with written
<br /> proof of construction costs incurred during any phase of the Project upon request.
<br /> 17. RIGHT OF ENTRY. City and DPD or their agent(s)may enter the Premises at
<br /> reasonable hours to inspect and do anything City and DPD may be required to do hereunder or
<br /> which City and DPD deem necessary for the good of the Premises, any improvements thereon, or
<br /> to otherwise promote the health, safety, and welfare of all tenants, guests,and invitees to the
<br /> Premises.
<br /> 18. DAMAGE BY CASUALTY. If,during the Term,the Premises are destroyed or
<br /> damaged by fire or other casualty as to become uninhabitable for the Permitted Use, then in such
<br /> event, at the option of City and DPD, this Agreement shall terminate from the date of such
<br /> damage or destruction. City and DPD shall exercise this option to terminate this Agreement by
<br /> notice in writing delivered to G&H within thirty(30) days after such damage or destruction.
<br /> Upon such notice, G &H shall immediately surrender the Premises and all interest therein to
<br /> City and DPD, and G&H's obligations under this Agreement shall terminate. If City and DPD
<br /> do not elect to terminate this Agreement,this Agreement shall continue in full force and effect,
<br /> and G&H shall expeditiously repair the Premises,placing the same in as good a condition as
<br /> they were at the time of the damage or destruction. G&H shall finther remove all rubbish,
<br /> debris,merchandise, furniture,equipment and other personal property within five days after the
<br /> request by City and DPD.No compensation or claim shall be made by G&H by reason of any
<br /> inconvenience or loss of business arising from the necessity of repairing any portion of the
<br /> building or the Premises.
<br /> 19. PERSONAL PROPERTY. City and DPD shall not be liable for any loss or
<br /> damage to any merchandise,inventory, goods, fixtures, improvements or other personal property
<br /> of G&H or its invitees, employees, agents, or lessees in or about the Premises.
<br /> 20. UTILITIES AND SERVICES. All utility costs incurred following the
<br /> installation of electrical service by DPD shall be the sole responsibility of G&H. Utilities shall
<br /> include,but are not limited to:water, sewer, electric,gas, garbage,phone, cable, and internet.
<br /> 21. LEGAL REQUIREMENTS. G&H shall comply with all laws,regulations,
<br /> ordinances and other public requirements now or hereafter affecting the Premises or the use
<br /> thereof, and G&H shall indemnify, defend and hold City and DPD harmless from all expenses
<br /> or damages resulting from its failure to do so.
<br /> 22. FIXTURES. Except for G&H's personal property, all buildings,repairs,
<br /> alterations,additions, improvements, installations and other fixtures installed or erected on the
<br /> Premises,whether by or at the expense of City, DPD, or G &H,shall belong to DPD and shall
<br /> remain on and be surrendered with the Premises at the expiration or termination of this
<br /> Agreement. However, at City or DPD's option, G&H shall remove G&H's alterations or
