INTERGOVERNMENTAL AGREEMENT FOR <br /> THE SHARING OF CERTAIN COSTS RELATED TO IMPROVEMENT OF <br /> PORTIONS OF VARIOUS PUBLIC HIGHWAYS IN MACON COUNTY,ILLINOIS, <br /> BETWEEN THE CITY OF DECATUR,AND HARRISTOWN TOWNSHIP <br /> WHEREAS,the City of Decatur, Illinois intends to implement highway improvement <br /> projects involving the use of micro-surfacing on various City Streets; and <br /> WHEREAS, Harristown Township, Illinois is desirous of implementing micro-surfacing <br /> improvements to various streets and roads under their jurisdiction; and <br /> WHEREAS, intergovernmental cooperation between the City of Decatur, Illinois, and <br /> Harristown Township, Illinois is financially beneficial to all agencies by jointly purchasing <br /> micro-surfacing services and products; and <br /> WHEREAS, Harristown Township is a body politic and corporate in the State of Illinois; and <br /> WHEREAS,the 1970 Illinois Constitution,Art. VII, Section 10 and 5 ILCS 220/3 provide <br /> authority for intergovernmental co-operation; <br /> WHEREAS, the Administrators of Harristown Township believe the improvement to various <br /> City Streets and other public roadways in Macon County, Illinois by the City of Decatur will <br /> be of benefit to the health, safety and welfare of the residents of Macon County; Illinois, and <br /> NOW THEREFORE, in consideration of the mutual agreement contained in this agreement, <br /> the City of Decatur and Harristown Township, Illinois agree as follows, subject to actual <br /> construction costs: <br /> 1. The City of Decatur agrees to act as the Lead Agency for the micro-surfacing <br /> projects unless or until the City of Decatur provides the other participating <br /> agencies thirty (30) days written notice of its intention to no longer act as Lead <br /> Agency. <br /> 2. The responsibilities of the Lead Agency are to facilitate micro-surfacing <br /> projects for the participants, including preparing bidding and construction <br /> documents, advertising for the bidding process, and awarding the contract for <br /> the project. <br /> 3. The Lead Agency shall pay for the complete and total costs to the contractors <br /> of micro-surfacing select roadways in the County of Macon with <br /> reimbursement to the Lead Agency by the other participants. <br /> Page 1 of 3 <br /> Exhibit A <br />
