Opinion of Counsel <br /> I, the undersigned, am an attorney, licensed by and duly admitted to practice law in the State of Illinois and <br /> counsel for and attorney for the City of Decatur. In this capacity, my opinion has been requested concerning the <br /> eligibility of the City of Decatur for grant assistance under the Consolidated Vehicle Procurement Program <br /> ("Program"), and I hereby advise the following: <br /> 1. City of Decatur is an eligible subrecipient under the requirement of 49 U.S.C. § 5311 or§ 5339, which I <br /> have reviewed and verified that Applicant meets the required criteria: <br /> 2. There are no provisions in City of Decatur's charter or by-laws or in the statutes of the State, the United <br /> States of America, or any unit of local government that preclude or prohibit City of Decatur from making <br /> said application for or contracting with the State for the purpose of receiving an award of paratransit <br /> vehicle(s). <br /> 3. 1 have verified with the Applicant and attest that Applicant has no past, pending or threatened litigation, in <br /> either federal or state courts, that would adversely affect this application, or that seeks to prohibit the <br /> Applicant from contracting with the State for the purpose of receiving an award of paratransit vehicle(s). <br /> 4. 1 have reviewed Applicant's organizational documents, or other relevant information, and certify that Scot <br /> Wrighton, City Manager, of City of Decatur is authorized pursuant to corporate charter, by-laws, <br /> ordinance, or by governing board resolution to, (a) submit and execute a grant application for financial <br /> assistance under the Program; (b) furnish such additional information as may be required by the Illinois <br /> Department of Transportation ("I DOT") in connection with the aforesaid application for said grant; and (c) <br /> execute on behalf of City of Decatur all required grant agreements with IDOT. <br /> Based upon the foregoing, I am of the opinion that City of Decatur is an eligible recipient under the provisions of <br /> 49 U.S.C. § 5311 or§ 5339, and that it is fully empowered and authorized to apply for and to accept the grant <br /> from the State. <br /> Signature: Date: _April 5, 2022 <br /> Attorney's Name: dy L.
