RUPLE for a Conditional <br /> Use Permit to allow for a large home daycare <br /> located at 1680 NORTH 30TH STREET in the R-3 <br /> Single Family Residence District. <br /> Ms. Suzy Stickle was sworn in by Mrs. Janet Poland. <br /> Ms. Stickle presented the recommendation of staff. <br /> The subject site is developedas a single familyresidence and located at 1680 North 30`" Street. <br /> The subject petition requests a conditional use permit to allow the operation of a large home <br /> daycare. The daycare would accommodate a maximum of eight (8) children. A large home <br /> daycare located in the R-3 District requires a Conditional Use Permit. <br /> The petitioner has enough parking in the driveway to accommodate two vehicles to drop off and <br /> pick up children, there is also on street parking that would allow for drop off and pick up of <br /> children from the proposed home daycare. There is adequate room for the children to play in the <br /> rear yard. <br /> There was a swimming pool located in the rear yard at the time the petition was filed. Staff was <br /> recommending the pool to either be brought up to code or be removed from the property prior to <br /> a Conditional Use Permit being granted. The pool removal was confirmed by the City of Decatur <br /> Building Inspections Division on Monday, June 1, 2015. <br /> Section XXII.A.3. lists three standards which must be met in order to grant a conditional use <br /> permit. The first standard requires the applicant to show that the use is "necessary for the public <br /> convenience at the location." The proposed use is generally compatible with the neighborhood <br /> and provides a service which can be utilized by area residents. <br /> The proposed use also meets the second standard. The home daycare is located and designed to <br /> be operated in a manner that the public health, safety and welfare will be protected. <br /> This use also meets the third standard. The daycare will not cause substantial injury to the value <br /> of other properties in the neighborhood. The daycare use will be required to meet all applicable <br /> City building and fire codes, as well as all requirements imposed by the State in the issuance of a <br /> home day care license. <br /> Based on the analysis, staff recommends approval of the conditional use permit as submitted <br /> with the following conditions: <br /> a. That the proposed operation be limited to a maximum of eight(8) children. <br /> b. That the proposed operation be in compliance with applicable provisions of the City's <br /> adopted Building Codes, including obtaining a building permit to perform any proposed <br /> or required improvements to the existing dwelling. <br /> c. That the proposed daycare be appropriately licensed by the State of Illinois at all times. <br /> The petitioner shall supply the City with a copy of the daycare license. <br />
