McElroy and City Council FROM: Tim Gleason, City Manager Billy Tyus, Assistant City Manager Suzan Stickle, Senior Planner SUBJECT:Conditional Use Permit for large home daycare at 1680 North 30th Street SUMMARY RECOMMENDATION: Staff recommends approval of the Conditional Use Permit for a large home daycare with the following conditions: 1. The proposed operation be limited to a maximum of eight(8) children. 2. The proposed operation will be in compliance with applicable provisions of the City's adopted Building Codes, including obtaining a building permit to perform any proposed or required improvements to the existing dwelling. 3. The proposed daycare will be appropriately licensed by the State of Illinois at all times. The petitioner shall supply the City with a copy of the daycare license. The City Plan Commission voted 7-0 to recommend approval of this petition at the June 4, 2015 meeting, the minutes of the meeting are attached. BACKGROUND: The subject site is developed as a single family residence and located at 1680 North 30t"Street. The subject petition requests a conditional use permit to allow the operation of a large home daycare. The daycare would accommodate a maximum of eight(8) children. The petitioner has enough parking in the driveway to accommodate two vehicles to drop off and pick up children, there is also on street parking that would allow for drop off and pick up of children from the proposed home daycare. There is adequate room for the children to play in the rear yard. Section XXII.A.3. lists three standards which must be met in order to grant a conditional use permit. The first standard requires the applicant to show that the use is "necessary for the public convenience at the location." The proposed use is generally compatible with the neighborhood and provides a service which can be utilized by area residents. The proposed use also meets the second standard. The home daycare is located and designed to be operated in a manner that the public health, safety and welfare will be protected. This use also meets the third standard. The daycare will not cause substantial injury to the value of other properties in the neighborhood. The daycare use will be required to meet all applicable City building and fire codes, as well as all requirements imposed by the State in the issuance of a home day care license. POTENTIAL OBJECTIONS: There were no known objectors at the Plan Commission Meeting, INPUT FROM OTHER SOURCES: The petition has been reviewed by the City's Technical Review Committee; Planning, Engineering and Fire.
