ECONOMIC AND COMMUNITY DEVELOPMENT MEMORANDUM No. 22-20 April 14, 2022 TO: Honorable Mayor Julie Moore Wolfe and City Council FROM: Scot Wrighton, City Manager Cordaryl "Pat"Patrick, Director of Economic & Community Development Greg Crowe, Assistant Director of Economic & Community Development SUBJECT: Ordinance Granting a Conditional Use Permit to allow for a ground based satellite dish in the R-1 Single Family Residence SUMMARY RECOMMENDATION: Staff recommends approval of the proposed Conditional Use Permit to allow for the construction of a ground based satellite dish and equipment cabinet with the following conditions: 1. A six (6) to eight (8) foot site break fence shall be constructed and maintained in good conditions around the perimeter of the compound as shown in the attached site plan. 2. Final site, landscaping and lighting plans shall be submitted to and approved by the Economic&Community Development Department and Public Works Department prior to building permits being released. 3. Parking areas and driveways shall be paved with a minimum of two (2) inches of Class I asphalt or concrete over a six-inch aggregate base, or other hard surface as approved by the Public Works Department The City Plan Commission voted 7-0 to recommend approval of the petition at the April 7, 2022 meeting. The minutes of the meeting are attached. BACKGROUND: The subject petition is a request for a Conditional Use Permit to allow for the construction of a ground based satellite dish and equipment cabinet within a proposed 12' x 25' fenced compound in the R-I Single Family Residence District. ViaSat is an Internet provider that serves remote and rural areas via a satellite connection that traditional Internet providers do not serve. As a utility use, the improvement is consistent with an integral part of existing and planned uses of surrounding property. When complete, this improvement will be connected to a localized fiber optic distribution network. For further details, please refer to the attached Plan Commission staff report.
