Book. 4893 Page: 190 <br /> Northwest Quarter of the Northwest Quarter to the place of beginning, situated in <br /> Macon County, Illinois. <br /> Permanent Index No. 18-08-31-101-004 <br /> WHEREAS, the Decatur City Plan Commission recommended that such <br /> Conditional Use Permit be granted. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS: <br /> Section 1. That the recommendation of the Decatur City Plan Commission be hereby, <br /> received, placed on file and granted. <br /> Section 2. That upon compliance with the conditions described herein, and in the Site <br /> Plan attached hereto and hereby made a part hereof as Exhibit A and the Business Plan attached <br /> hereto and hereby made a part hereof as Exhibit B, said herein that a Conditional Use Permit <br /> be, and it is hereby, granted to SHANERS TOWING AND TIRE, INC as the petitioner, and <br /> only to allow for an Automotive Salvage Operations in the M-2 Heavy Industrial District. <br /> 1. A nine (9)foot site break fence shall be constructed along with the existing six(6)foot <br /> site break fence around the perimeter of the property as shown in the attached site plan <br /> labeled Exhibit A and the Business Plan labeled Exhibit B to visually screen the use <br /> from the adjacent properties and roadways. Both the existing and new site break fence <br /> shall be maintained in good condition to stay in compliance with this Conditional Use <br /> Permit and the City's Zoning Ordinance. A site break fence as defined in the City's <br /> Zoning Ordinance and for this conditional use permit is "A physical barrier designed <br /> to screen buildings or uses from adjacent properties." <br /> 2. No stored and/or salvaged automotive vehicles and parts shall be visible from adjoining <br /> properties and roadways and shall not be stacked any higher than nine (9) feet. <br /> 3. No products or materials besides automotive vehicles and parts and equipment for the <br /> salvage and recycling of those vehicles and parts shall be salvaged or stored on the site. <br /> 4. The vehicle crusher shall not be used between the hours of 8:00 PM and 8:00 AM. <br /> 5. In accordance with the City's Zoning Ordinance Performance Standards for uses in the <br /> M-2 Heavy Industrial District, no operations on this site, including but not limited to <br /> the use of the vehicle crusher, shall produce a source of sound in such a manner as to <br /> create a sound level which exceeds 80 dBA, when measured in accordance with the <br /> American Standard for the Physical Measurement of Sound. Such measurement shall <br /> take place at the property line of this site. <br /> 6. The petitioner, Shaner's Towing, shall provide the City Economic & Community <br /> Development Department an annual report, before December 31 of each year, <br /> confirming that the site is in compliance with all of the conditions of this CUP Permit. <br /> Any conditions not being met shall be cause for City revocation of the CUP. <br /> 7. The petitioner, Shaner's Towing and Tire Inc., shall provide the City Economic and <br /> Community Development Department a bi-annual report on June 30 and December 31 <br /> of each year, detailing monthly, the previous 6 months intake of salvage cars and the <br />
